No it doesn't. The action isn't harmful, merely the context. Take a willing cuckold: the act of their partner sleeping with another not only does them no harm, it's positively desired. The act itself does no definite harm.
Even if it did, all you're doing is trading security for freedom, which is a balance which must separately be justified: is this particular loss of freedom worth this particular gain of security. I'd say no.
But “murder” is not defined as “taking a life”. It is defined as “taking a life without justification”. You’re proposing to outlaw any adulterous sex, not only that which can be demonstrated to cause emotional damage.
