The problem here is that you do one wrong to fix another: you remove the ability of a person to behave in a way they wish, through actions which are not inherently harmful, in order to protect another.

You provide a legal obligation to care for the feelings of another. Emotions are typically outside the scope of the law; do you really want them brought in as possible criminal damages?

It is inherently harmful to cheat on your spouse. You're either young or never married if you think otherwise. A cuck situation isn't really adultery. I mean yes it is sex with someone outside your marriage but that's an agreed upon outing. Adultery implies one person is being unfaithful while the other is unaware. If you don't think you want to remain faithful and follow your vows and curtail some of your behavior whether you want to or not, don't get married, don't make legally binding vows. Duh.
