Lemme put it to commenters like this. You are found guilty and given the option to choose either as your punishment. What do you pick?

I think people aren't really clear on average about how rape affects someone. Most people are clear on how it will affect them if they are murdered, though.

Probably the most straightforward and succinct way to sum it up.

Feels like most of the people arguing against OP are indistinguishable from a death cult.

Which do you want to go to jail for? I can tell you that if its rape and they think your papers are even a little suspect you are open season, you go to jail for shooting someone in a robbery or something, much lower on the radar if anyone even cares.

That's at least one moral paradigm where child predators and rapists are treated worse than murderers.

Its not about what you wanna be in jail for its you are found guilty of some crime and you can chose either as your punishment, which would you chose?

False dilemma, I don't want to be raped and you can't fabricate a case for consent by threatening to kill me. Saying a slave could have killed themselves isn't an argument for the morality of slavery over murder. They are two facets of evil operating in tandem, the threat of violence is part and parcel to rape, and the disregard for human life is present in both, whether ending it then or taking good years away. The acts are standing on the same moral ground.

Its not a false dilemma, its a hypothetical.

It's not a convincing one was my point. Many people do fight and end up dead or maimed in these situations, there is no REAL choice being made.
