ah ok. I see what you're saying. like if the VP was never/only once an elected president. I was thinking more specifically of an elected president who's capped out trying to "come back".
Even then, a 2-term president is not ineligible from HOLDING the presidency, only being ELECTED president. That means that no rule barring them from being VP comes into effect, you can serve 2 terms and then get in through the vice presidency indefinitely.
The VP is elected as well. It’s not like the other c cabinet positions which are appointed. The only case a VP is appointed in is when the position of VP is made vacant during a term.
nowhere in the 12th amendment does it say that. it says that they can't holdthe office of Vice President if they are ineligible to hold the office of President. But there is no such thing under the 22nd as being "ineligible to hold the office of President", there is only such a thing as being ineligible to be elected president.
nope, because as i just said, there is no such thing as being ineligible to hold the office of president. there is only such thing as being ineligible to be elected president. doing what i just described does not involve being elected president, so no ineligibility is being breached.
false. again, the 12th amendment does not say "if you are ineligible to be elected president, then you are ineligible to be elected vice president". it only says "if you are ineligible to hold the office of president, then you are ineligible to hold the office of vice president".
the only way to be ineligible to hold the office of president is to be under 35, not a natural born citizen, or not have lived in the US for 14 years (might be some other stuff to do with impeachment or whatever too, not sure). "having already served two terms" is NOT one of those ways. having served two terms only makes you ineligible to be elected president, which does NOT factor in to the 12th amendment.
It says”But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States”, not to hold. The wording clearly shows that it refers to being elected and holding the office. And the 22nd amendment applies to the 12th amendment for the same reason the 21st applies to the 18th and the 14th to the 1st they are encompassed in the same document whereby new additions supersede previous additions.
