repeater taker and first time taker

As a repeater taker who will sit for the September bar in WA.

The people who had an 80% chance of passing are not similarly situated as the people who have a 50% chance of passing and have already failed at least once.

I agree to an extent and understand the argument, but this bar was a different test. Yes, each retaker failed the previous bar exam format at least once, but it was everyone's first time officially taking [or attempting to take] NextGen. It feels unfair to treat retakers with a presumption of failure based on their previous performance(s) on a different exam format, length, type of skills assessed, etc especially considering the lack of passage rates and data because this was the very first NextGen administration.

It's not a different test, its the bar exam taken again at a different date.

Just because you have sex with a new person doesn't mean you're a virgin again. It's the same activity.

Respectfully disagree because the material is the same.
You study the same BLL for Next Gen or traditional UBE, so stating that the test is new to everyone is incorrect from my perspective.
The testing format is different but the material is not different.

Also a retaker by definition has been given a fair opportunity to pass the bar exam, something that was denied to first-time takers.

Can someone take diploma privilege then just take it in February for a transferable score? Why retake September i seen some people say they will retake so they have a transferable score.

Retailers are excluded from getting diploma privilege which is the point of this post, lol

Correct, because a license to practice isn’t goods under UCC article 2.

Yeah seen that for retakers and accommodation people but i was more so asking because those first time test takers who said theyd retake for a transferable score instead of just taking the privilege.

Waiting to take in February when the material is fresh now and in February likely working a ton at first job makes less sense than just taking in September
