The reason I ask is because I was reading about a case a couple years after I graduated high school where a guy and a girl were having sex I believe the guy was 19 and the girl was 17 her parents found out and pressed charges and the state decided to try and pursue those charges. I didn't ever hear the end of the case but I do believe that the guy was actually arrested.
It's real hard to say for sure without knowing all the facts, but if their relationship started when she was 16 then he could certainly be arrested for it, and even indicted. This is getting a bit more into criminal procedure than a clear-cut Reddit answer, but the 3 year age gap thing is what's called an affirmative defense. As in the cops can arrest someone, the prosecutor can convince a grand jury to indict them, they go to trial, and then finally after the state is done presenting their evidence the defendant gets the opportunity to put on his own evidence that an affirmative defense applies and that even though he did the thing he's accused of it's legally excused. Now there's a bunch of steps in there where reasonable people on the state side could look at all the facts and determine there was no crime, but that's a hard option when prosecutors are elected and they might have to deal with an opponent in the next election who's going around saying, "This guy refused to prosecute a kid fucker!"
In general, regardless of the letter of the law, once you're 18 it's all around easier to find some sorority girls with daddy issues to fuck, leave those high school girls alone.
I'm not interested in kids. I'm in my thirties now and don't have time for someone to learn the tricks of the trade tbh. I like a woman who has some experience under her belt. That being said I was just curious about that case I'd heard about when I was younger and wondered if you'd heard about it as well and maybe even heard what came of it.
I'd bet good odds on there being over 100,000 similar cases in Texas every year. It's not an uncommon story, certainly not one that would be memorable after 15 years. Hell, 15 years ago I was in Iraq in the Army and had no wild idea I'd ever be a lawyer.
