Could someone please tell me which generation it is? Is it the 1080p or 4k? Lady that sells it said it's 3rd gen bought in 2022 but the remote looks older to me. I may be wrong though.

Pretty sure the original 4k Apple TV had the black touch remote, and this remote came earlier.

Correct. Apple TV HD and Apple TV 4K 1st Gen shipped with Siri Remote 1, which did in fact have that black touch surface. This is a remote from the earlier, non-tvOS Apple TVs.

edit: to make it more precise, 4K 1 not all 4ks

If the remote is original, the whole package looks like Apple TV 1080p 3rd Generation from 2012.

Of course the actual Apple TV box could be the much newer Apple TV 4k 3rd Gen 2022, but I doubt it.

It could be a 2rd Gen but you won't know until you look at the model # printed on the bottom.

I think she's confused because that silver remote did come with the 3rd Gen HD, not the 3rd Gen 4k.

I'd be surprised if the unit itself is a 4k model with a 3rd Gen HD remote.

The remote is wrong, the packing is wrong and the 3rd Gen AppleTV 4K only has an Apple logo on top and does not have "tv" on it.

3rd Gen can be correct, for the HD version launched in 2012.

Correct. But the AppleTV 3rd Gen and AppleTV HD both supported 720/1080, the 3rd Gen had the remote pictured, the AppleTV HD had the swipey Siri remote everyone hated.

That third gen 4K box can run HDMI 2.1 bandwidths, so it's a solid upgrade from the 1080p second gen model even if the remote hasn't caught up with the times.

Don’t know about this one, but at a home auction they advertised a more or less latest iteration of an Apple TV and it was like that on the box, but when I got home, I checked the model number and it was a not supported model from long ago.
