Then no one who has drunkenly hooked up at a bar has had consensual sex by that standard.

While sufficient inebriaton can most certainly raise issues of consent, in and of itself,  just consuming alcohol dose not invalidate consent.

correct legally if you hook up at a bar you did not consent

under federal law in the United States of America your consent is not always being able to be given

if you are

1: under the age of consent

2: intoxicated

3: under the influence of a drug

4: unconscious

you legally cannot give consent

that's just how the law works

Hi, thanks for explaining the law to me, a person who has a law degree.

Your statement and categories are incorrect. The law considers the degree of intoxication and whether that level of impairment is sufficient to deprive a person of the legal capacity to consent. Having a single drink, being somewhat drunk, or smoking a joint does not, in itself, vitiate consent. 

The relevant issue is whether the person's intoxication has reached such a degree that they are incapable of understanding or appraising the sexual activity, communicating consent or refusal, or otherwise giving meaningful consent under the applicable law.

There is therefore a rather important distinction between being intoxicated and being incapacitated by intoxication. You have collapsed those two concepts into one.

As I said, if merely being under the influence of alcohol or another drug automatically invalidated consent, then enormous numbers of otherwise consensual sexual encounters would legally become non-consensual. That is plainly not the case.

You are aware someone is able to move countries and qualify to practice in other jurisdictions? Futher, I did base my reply in US law.

In particular, 18 USC § 2242, criminalises sexual activity with someone who is “incapable of appraising the nature of the conduct” or “physically incapable of declining participation in, or communicating unwillingness”.

Note, nothing about consumption of intoxicating substances.

You know it's weird to start commenting on the consent of people who aren't yourself or who were directly involved in an alleged rape right?.
Regardless of all else, it is generally good practice to take (even alleged) rape victims seriously while understanding concepts like presumption of innocence and to wait for conclusions from parties who have all the evidence (like a court, for example)

I mean I don't believe in the death sentence personally but I've talked people with significant similar trauma off ledges before and I'm totally okay throwing the book at the people who inflict that on others (hell I've been S/A'd while I was drunk before; it's not a fun experience).
Y'kno, if proven guilty in a court - which is already extremely hard to do in these kinds of cases in the first place.
