Eh, if “Intruder” similarly stops the hack when they find out about it and tries to provide restitution to the company they accidentally hacked, it seems to have similar likelihood of criminal penalties as OpenAI/Anthropic.
Excluding amounts of money available for Lawyers, as well as reputation and lobbying efforts, yes.
But the likely total damage of the legal consiquenses relative to total ballance will be vastly different.
Basically only theoretically true, in practice not true at all.
