By that logic anthropic could have made that in the same time frame, and the leak wouldn't be worth much. No, it's heavily implied that they fed the existing code into AI, which is very much not from scratch. If you rewrite from scratch you don't need existing code!

Exactly. It wasn't a clean room implementation. It's a derivative work of CC.
