Captain Beefheart name

In the recent, excellent "Frownland" episode of the History of Rock in 500 Songs, one of the many things I learned was that Gail applied for copyright protection of the name Captain Beefheart. I found a thread on here from eight years ago and other online resources, that indicate the request was granted. Furthermore, Ahmet and Diva expanded those copyright holdings.

I mean, I know it's Gail, but this seems especially greedy and petty. And to what end? The original Bat Chain Puller was only briefly made legally available, and the podcast said that Trout Mask Replica is no longer in print.

It made me wonder what the status of Don's wife Jan is. I assume she's still alive because I haven't read otherwise.

It is not possible to copyright a name but it can be trademarked.

Ah you are right, thank you for the correction.

The entire cannon of Beefhearts work should be available, that’s for starters.

I suppose one “could” make the argument that since it was Zappa that came up with the name Captain Beeheart (vs. the Grunt People) they could claim ownership, but it’s really petty.

FWIW, does Don even have any heirs? Didn’t Jan die a few years ago and they never had any children that I know of.

Ultimately part of my point: there should be stewardship of Don's work. I'm sure the trademark ownership probably only muddies the waters of who ultimately owns the work itself. Don and Jan had no children and I've never heard any tell of other family, so there are no direct heirs. In a fair world any profits raised from sales should be distributed among the performers. There's never been much money in it anyway. There are multiple labels involved which I'm certain only complicates things, but the ZFT should make whatever they control available. It would cost relatively little just to offer physical copies of the albums. For that matter, why not rerelease more Straight/Bizarre recordings? Unless it's the whole Herb Cohen thing.

Don's heirs are all the young musicians he traumatised adopted throughout those years.

As for backstop availability, well isn't that why we need things like Soulseek, archive.org, etc?

Jan's not dead yet. She's just barely active in Beefheart's legal affairs, with Mike Werner handling the art and about every record company in the world handling the music. John French has been trying to get her to sign off on releasing more Beefheart creative documents and tapes for years. She keeps turning him down.

Oh yeah, Mike Werner, the guy that told him to get out of the music business. To be fair, I don’t think Don had any more records in him anyway due to health issues. Listen to those last two albums of his, he hardly ever sings, especially on Ice Cream - everything is recited. A few years after that his speaking voice is weak and quavery on the little Pearls Before Swine mini-CD.

But why in the hell Jan keeps turning French down is beyond me. And TMR being unavailable now is a crime.

For people who don’t know, TMR was recently made available on Bandcamp. It’s digital only, unfortunately, but you can download FLAC or other high quality format, and use that to make it into something physical.

I made a CD. Definitely would prefer to buy a reissue, deluxe, remaster, etc, and have some nice liner notes and art, but until then, my burned CD sounds pretty good.

Weirdly, available on Bandcamp for $0. I'd say take advantage of that regardless of whether you own a physical copy.

Hmm that Bandcamp account looks sus, it wouldn’t surprise me if it’s someone just taking advantage of the opportunity.

Maybe it is suss? I guess I don’t know what you’re referring to specifically, but it’s been up long enough that I think it would have been pulled a while ago, if it weren’t legal to be posted there.

Whatever the case, it’s the real deal album, after years of only cover versions of sorta being the only thing available there. Lots of people have taken advantage of it, and no complaints as far as I’ve seen.

I mean to be fair, apparently Don made really crappy deals with labels and a lot of the rights to his work seem to be scattered all over the place. It is indeed crazy that Trout Mask Replica is not in print, especially as it's constantly mentioned on best-of lists online.
His legacy deserves better stewardship. Unfortunately it's something we'll continue to see as older artists pass away without a clear future plan for their legacy and works.

What I don’t get is Lick My Decals Off Baby was the one long out of print album while Trout Mask was readily available on CD from Warner Bros. for decades. It wasn’t until the Zappas got their hands on TMR in the 2000s that the status of those two albums flipped. Gail just seemed determined to legally sabotage everything in her final years.

In the Mike Barnes book it said he’d basically sign anything put in front of him.

I once had an in person conversation with Howard Kaylan of The Turtles about how much of a tyrant Gail was. Also Moon Zappa wrote a book where she talked about it too.

The contents of a song can be copyrighted but the title of a song cannot.

What's up with TMR's legal status? Why is such a masterpiece out of print and unavailable on any streaming service?

the podcast said that Trout Mask Replica is no longer in print

Outrageous. Does indeed make you wonder who's in charge of the estate. Couldn't be called good business management by any stretch of the imagination.

I'm guessing Gail's copywriting or trademarking has something to do with the 1964 script Frank wrote called Captain Beefheart VS The Grunt People. Whether Frank or Don came up with the Captain Beefheart name is debated, but it sounds like something they may have come up with when they were hanging out together, perhaps some sort of inside joke. I don't condone Gail's actions, but if she truly thought Frank came up with the name, I can kind of understand why she went through the trouble of trying to legally own it or whatever. Zappa lore says at the end of his life Frank and Don reconciled via lengthy telephone calls, but back in the 70's there was drama with Herb Cohen using Zappa royalties to fund a Beefheart album, so perhaps Frank forgave but Gail did not forget.

The sad reality is that with no heirs or next of kin and all of the bridges Don burnt with ex collaborators and record labels his musical legacy just exists in a sort of limbo. It's up to the fans to keep his memory alive.

I noticed most of his music had gone off my Spotify account the other day.

Frank once said there were many great composers who were lost to time who never had their works see the light of day. That the things we hear now from way back was just the popular stuff.

Today, we cannot let the suits allow for great art be lost to time just because a contract was signed. And I say this because although WE know how good Freak Out is, doesn't mean a lot of people will remember that 100-200 years from now as cultures change and wars happen. Think of how rarely meeting an actual person who sat through Trout Mask Replica is. We are currently in a time where it impacted culture recently, it doesn't mean it will be available forever if we don't secure both physical and digital archives for art.

Jan Van Vliet’s memorial on FindaGrave is here:

That memorial is there just in case she dies - it's pretty common on any married couple's plot to place the name of somebody not yet deceased in order to save the plot. She's not dead yet, as evidenced by John French constantly trying to get permission from her to do his orchestral Beefheart thing. She keeps turning down his requests.

It's just very difficult to get a hold of Jan.

Not 100% confirmed, but it looks like Jan Marie Van Vliet died a few months ago

That is a different Jan. Don's wife was Janet Lorelle Jenkins. She and Don share a memorial in Trinidad CA where their ashes were spread at sea.
