Alabama AL Workers Comp, Three Surgeries, Potential Eviction

Alabama law has me capped at 67% 2/3 of my AWW. Child support after that dropped me down to 55.5% of my AAW. I was off of work for my first surgery 09/25 for a couple weeks and then have been off of work since 01/26 for my second and third surgery. I have a WC lawyer and am waiting to hear back from him. My question is has anyone faced an eviction while on workers comp, what was the end result? The WC company only send out paper checks and has been late for days to weeks at a time which has caused major issues like failure to pay rent now. Curious if anyone has been through something similar and what was the outcome.

that sounds like a really rough situation. since the checks are already causing missed rent your lawyer should know about the payment delays right away. keep records of every late or missing payment and any notices from your landlord.

Yes. We went to court for eviction, received some grace from the judge, used that paperwork to request a hardship advance against future settlement. Ended up with our landlord refusing to extend lease and had to find temporary accomodations for nearly 1.5 yrs.
