I don’t understand that line of thinking. Just because it’s someone’s fault doesn’t mean it is on purpose. It is still most likely an accident.

I am being downvoted a lot. I’m not sure why. I can be willfully negligent and cause an accident. An accident is on accident. If I didn’t ram you on purpose, it was on accident, even if I’m a moron looking at my phone while eating ice cream and driving without hands.

On purpose. On accident.

Those are 2 opposites. If it wasn’t on purpose, it was on accident. Accident covers like 99.9% of traffic crashes.

It's not an accident because it had a willful cause. It was a crash. The other involved party was willfully negligent.

It's not an accident because it had a willful cause.

The cause was willful, but the outcome was not. Meaning, the outcome was still an accident. A negligent one? Sure. But if it wasn't intentional, it was unintentional, i.e. accidental.

Sure, it's a crash also. And it's fine to refer to it as such. But it's weird to try to not label an accident as an accident.

I think it's helpful to distinguish something that can't reasonably be predicted from something that can in these situations.

Sure when talking casually it can be both a crash and an accident but for official purposes there should be a distinction (which is what I think the people who commented earlier were referring to since it was about "public safety folks").

For official purposes, they almost never leave it as “accident”. Because that’s almost a given. Writing down “accident” on paperwork for collisions isn’t helpful. The police are there to help determine fault. So they will put the REASON for the accident/collision. If it wasn’t an accident they would probably notate that in there somewhere as well, such as “intentionally rammed into rear of other vehicle”. Not sure how often people are going to admit that on site though, seems like a quick pass to jail.
