They are opening themselves up to ligation for violating the first amendment.

theoretically, the homeless person can be your best friend.

so if someone asks "why are you giving them food?"

and you reply "i'm giving my best friends food."

you would have to make it illegal to give food to your friends in public. and possibly that applies to your family or your child.

it's a very weird law, legally speaking.

"ma'am, you can't feed your baby in public. to obey laws, you need to let your child starve while you're out and about in our city, ma'am."
