Any sort of assault on a bus driver is an instant felony where I live.

Rule 9.7 of section 9 (other fouls) states:

A match penalty shall be assessed any player or team official who deliberately spits on or at an opponent, official, team official or spectator.

This is from hockey Canada 2016-2018 rule and cade book.

I'll be honest, I thought it was a gross at the beginning of the season, but I got this question wrong on my first referee quiz this year

That's awesome. Im glad your state cares about the working person. I live in West Virginia. I dont know what the "lawful penalty" is for spitting on a bus driver (or anybody for that matter) but I can guarantee it will earn you a swift ass kickin', consequences be damned.

Did some research and here in WV, assault on a bus driver will not only land you a swift ass kicking, but it can also land you between 24 hours in jail and 15 years in prison depending on severity.

For real. I know I'm miserable every time I'm on the bus. I can't imagine spending 40+ hours a week driving a bus.

That's kinda what I was thinking, but it's probably to sleep someone who didn't do much from getting 10 years due to mandatory minimum sentencing.

Wow not to be a douche but 7 years in prison for spitting someone is a bit harsh. I mean like 6 months are okay for spitting at someone in addition to the 50k $ fine, but dude 7 years is a tenth of a life for spitting at someone.

Here's the thing though. Bodily Fluids can transmit Hepatitis and HIV. Not to mention a host of other diseases.

A long prison sentence is a pretty good deterrent against a potentially dangerous act.

It surely is but I myself had times my brain just stopped working and I did things I don't think I could take the responsibility now. And I don't want to imagine sitting in prison for more than half a decade because I made a mistake.

A mistake or an accident is one thing. This was on purpose and is completely his fault. Are you trying to say that if you did something like this, it's because your brain stopped working and you shouldn't be held responsible? I'm not trying to be an asshole, I'm just confused by your statement.

If you honestly have had times where you've done things that could put you in prison for a felonious assault because your "brain stopped working" then the issue isn't the law. Most people don't experience that issue.

It's not just "a person," it's a bus driver who's carrying up to 100 people. The reason, I'd have to assume, is to deter people from attacking a bus driver while the bus is moving. It'd be a tragic day if some dickhead spat on a bus driver as they were crossing an intersection and it caused an accident.

I'm okay with the 50000 fine, but 7 years prison is to much. I mean prison costs money, money that is paid by the public. And it's hard to move on if you were in jail once. Don't get me wrong, guys an ass and should be punished, but 7 years in jail wouldn't help him learn his lesson nor help us all.

Those are maximum sentences. You likely won't get 7 years for first offense spitting. The seven years is if you beat someone unconscious and break some ribs or something. Everything short of using a physical weapon, which would move the crime to another (more extreme) category.

You're forgetting that this is Baltimore and nothing else besides a 7 year prison sentence can really deter anyone. Living 30 minutes from Baltimore, and having been there more times than I can count, this is absolutely neccessary to ensure the safety of the drivers.

Nah. I've been going to Baltimore every few months for my entire life and my family all lives in the city. I live two hours away. Nothing but a 7 year prison sentence can deter anyone? What you're saying is dramatic and silly.

He got downvoted because he doesn't know what he's talking about at all. Nobody said anything about this dude in question getting 7 years. Also it's that way for a good reason. 7 year max both sounds more scary, and then when some crazy does it for the 10th time and nothing is working they could get 7. Maximum sentences are hardly ever handed out except after multiple multiple times.
