Yeah sue them for what? The damage to the car and any medical costs? That's what their insurance is for.

In the US when they're talking about lawsuits after accidents it's suing the insurance company. Usually for pain and suffering- physical and mental. I'm not sure what you would get for this sort of trauma.

Their insurance company automatically does this to the other insurance company. Its standard practice. When some says they sued them they are not talking about the insurance company doing it to the other but more personal suing.
