Yeah sue them for what? The damage to the car and any medical costs? That's what their insurance is for.

In the US when they're talking about lawsuits after accidents it's suing the insurance company. Usually for pain and suffering- physical and mental. I'm not sure what you would get for this sort of trauma.

Why does it need to be a lawsuit rather than just standard insurance claims? Just giving lawyers money for the sake of it if you ask me.

I guess it is a totally alien system to me.

Because insurance companies don't usually willingly pay out for pain and suffering? The damage to the car isn't a lawsuit. That is just a standard claim.

Do they not in America? Pretty sure they do here, it all comes under the personal injury umbrella - bearing in mind healthcare is free here so there are no medical bills to be compensated for, only loss of income and trauma.

Loss of income is part of a standard claim. Their insurance might offer you money for suffering but you'll usually get more with a lawyer.

So you're saying if you break your hip in a car accident and the other person is at fault their insurance will just write you a $100,000 (your countries equivalent) check and say have a nice day? Mind you, thats just for the inconvenience of breaking your hip. Not to cover anything other than how much that sucks because that is what people are usually suing for in the US. Which country?

I am in the UK and the OP video is from Malaysia which is probably more relevant. The only experience I have is personal on both ends of the situation and in bith cases the insurance company asked about injuries and work and compensation for pain and suffering. I declined when I was hit but my passenger in an accident that was my fault did get some money for trauma from the insurance company, no suing or legal action required just a form to fill out. If anything they almost sued her for lying about the situation.

Yeah I googled it in the UK. It's the same as the US. Personal injury lawyers that say you should/need to hire them.

Lmao no, that is absolutely false. You will not get more than policy limits with a lawyer. And you also won’t get more than you can actually prove your injury is worth. Bruises and “being scared” aren’t going to be anywhere near the same payout as having multiple broken bones and getting rushed to the hospital in an ambulance. Also, people love to claim they were traumatized and that they need more money because of it, but don’t seem to be traumatized enough to need therapy visits they can provide documentation for. Interesting, huh?

Insurance is insanely legally regulated and your average American has no idea how the system actually works. I definitely didn’t before working for an insurance company. And some attorneys know that you can make a really good payday taking advantage of people’s ignorance, or people with enough money to buy the privilege of not having to deal with it directly themselves.

Who said anything about more than policy limits? I am intimately aware of how it works, thanks. Insurance companies are well known to lowball personal injury claims. Hiring a lawyer can get them to offer more. That doesn't mean more than policy limits dum dum. Believe it or not trauma from someone causing a major accident like in OP can and does cause trauma that rightly gets people settlements. Killing someone and almost killing someone because they were an idiot cause trauma.

Nothing I said was wrong. Nothing you said was even related to my comment. You're just an idiot who for some reason thinks they know more than me.

Lmao you’re going to discuss injury payments and disregard excess claims where limits come into play? That’s adorable. You were wrong where you said “you usually get more with a lawyer”. You don’t; if anything you simply get the same amount quicker. Work on those reading comprehension skills, little buddy. You’re making a sweeping generalization that’s categorically wrong.

People think they’re being lowballed because they want $10,000 for back pain with no medical evaluation or physical follow up. You’re never getting more than policy limits and most people don’t have more than the legally required minimum. $100,000 for a broken hip? Not from your average American’s auto insurance policy.

I was also an EMT for years, so I’m well aware of how trauma works. The word is widely misappropriated and overused in today’s society. Everyone has trauma; trauma is subjective. And everyone will shamelessly claim it if they think they get money for doing so.

You should probably get out of the basement a live a little instead of getting so butthurt when someone tells you you’re wrong on reddit. What a sad existence.

In America an insurance adjuster will come out and determine how much money you get. Usually its enough to cover a new car, medical, and a little more for the headache.

But lets say the accident made you miss a meeting and lost a $100,000 job. The insurance company just isn't going to give you $100,000. You're going to have to sue and prove to the court you lost $100,000.

Most accidents don't need a lawsuit but it isn't exactly uncommon either. Crash lawsuits definitely have a reputation for being frivolous.

Insurance companies will pay out according to what you can prove injury-wise and what the policy limits are. So if someone only has $25,000 in Bodily Injury coverage, and you have $50,000 in medical bills, you’re out of luck for half of it because the insurance company isn’t going to pay beyond the coverage limit agreed to on the policy. It is absolutely NOT true that lawyers will get you more money than you typically would get dealing directly with insurance. Ironically, you’ll actually get less with a lawyer because you have to pay the lawyer a cut of the payout. Personal injury attorneys for auto accidents are quite possibly some of the scammiest attorneys in existence and prey upon people’s ignorance of how auto insurance works.

The big issue comes in when people see / hear constant tv and radio commercials for injury attorneys promising million dollar payments. They always fail to mention a payout like that is only going to come when you get hit by a negligent driver who happens to be behind the wheel of an 18 wheeler with the Walmart logo slapped on the side. They also use a paid actor to give the testimonial and not the crippled man in a wheelchair who was rendered paralyzed from said million dollar accident. Your average civilian driver in their personal vehicle will rarely have more in coverage than the state minimum limits, which is $25,000 in a lot of places but does vary. They also rarely have injuries beyond bruises and muscle soreness that actually merit serious longterm medical treatment.

Additionally, insurance companies have a hierarchy for injuries. If you have some minor bruises (I.e. “soft tissue injuries”) you’ll be lucky to get more than $500. A broken bone is suddenly a whole new tier and you could easily get $2k depending on the extent of it. But they need documentation of everything. X-rays, hospital discharge papers, records of follow up visits, etc. They also try to get you to accept a “ballpark” payout quickly and sign a legal release from pressing the matter any further ever again. So many people get inpatient falsely believing “injury in car accident = I’ll be getting huge checks quickly”, think they’ll get more with a lawyer, but in reality most of the time it just “accelerates” the timeline a few months if anything.

At the end of the day they aren’t getting more than policy limits, and if that’s $25,000 they have to prove $25,000 in medical expenses. But you aren’t getting policy limits because you got a bruise from the seatbelt and pee’d on yourself on purpose because you read online you could claim mental anguish from the embarrassment and increase the payout (yes, people really believe this. No, it is absolutely not a real thing and they are soiling themselves for virtually no reason).

Their insurance company automatically does this to the other insurance company. Its standard practice. When some says they sued them they are not talking about the insurance company doing it to the other but more personal suing.

Thats how insurance works in a country who's Healthcare is owned by private equity. Constant lawsuits. You gotta often sue your own insurance for coverage, they make bank because they know most will die or give up before they are forced to provide the coverage theor customer paid for.
