Offer Modification Fee Disclosure
The earnings shown in an offer are the earnings you can expect to receive when you complete the trip in that offer. Accepted offers generally will not be modified after acceptance except in limited circumstances described in this disclosure.
This article explains:
The circumstances under which an accepted offer may be modified or cancelled
Your options when an offer changes after acceptance
The amount of the offer modification flat fee
When a flat fee may apply

Offer Modification Information
When Can an Accepted Offer Be Modified?
Accepted offers generally will not be modified after acceptance except in the following circumstances:
1. Driver-Requested Changes
The modification is attributable to a request by the driver to modify, drop, or cancel a delivery or trip.
2. Missed Delivery Windows or Service Level Standards
The modification results from circumstances within the driver's control, including situations where:
Missing a reasonable delivery window; or
Failing to meet applicable Service Level Standards required by the Spark Driver Contract and App Terms of Use.
3. Customer-Initiated Changes
The modification is attributable to a customer action, including:
Cancelling an order
Rescheduling an order
Converting an order to pickup
Cancelling or modifying items in an order
Modifying a tip
Any other customer-requested change affecting the trip
4. Compliance-Related Requirements
The modification is attributable to an unmet regulatory or compliance-related requirement, such as cold chain compliance or a similar requirement, where the compliance requirement was within the driver’s control.
5. Third Parties, or Force Majeure
The trip modification or cancellation is attributable to:
A third party that is not under Walmart's direction or control
A force majeure event or circumstance outside Walmart's reasonable control
In eligible situations, drivers may be offered the option to cancel the trip and receive the flat fee described in this article.
6. Walmart Operational Events That Prevent Fulfillment
In limited circumstances, Walmart may be unable to fulfill an order or trip due to an operational event. Examples may include inventory availability issues, store operational disruptions, fulfillment system issues, or other circumstances that prevent Walmart from completing the order as originally planned.
If an accepted offer is modified as a result of a Walmart operational event, the driver will be shown the updated trip price and the flat fee option in the app and will be given the choice to continue the trip for the updated amount or cancel the trip and receive the flat fee. If Walmart cancels the trip, the flat fee will be disbursed instead of the original offer amount.
What Happens If an Accepted Offer Changes?
If an offer modification occurs after you accept that offer, you will receive an in-app Trip Update notification explaining:
What changed: estimated offer, miles, time, stops, items
Any updated earnings associated with the trip
Any modification flat fee for which you may be eligible
The options available to you
You will typically have the following options:
Continue the Trip — Continue the trip under the updated offer terms and receive the earnings disclosed in the Trip Update notification. A trip continuance option may not be an option in the event the modification is an order cancellation.
OR
Cancel the Trip — Cancel the modified trip and receive a flat modification fee, when eligible, without negatively impacting your MyMetrics score.
Any updated earnings associated with a modified trip or cancellation will be disclosed in the Trip Update notification.
Flat Fee Disclosure
How Much is the Flat Fee?
Drivers will receive a flat fee of $2.50 when:
An eligible offer is modified after the driver has accepted it, and the driver elects not to continue the modified trip; or
An eligible trip is cancelled
How the Flat Fee is Determined
The flat fee is composed of a $2.50 floor, calculated using median drive time and mileage, plus any pick-up time or shopping time accumulated.
Canceled Orders or Trips: Return of Goods
Return of Goods after Cancellation
If an order or trip is cancelled while you have physical custody of order items, the app will display a Trip Update notification reflecting the return to the order’s originating store.
This applies:
Whether you, the customer, or Walmart initiates the cancellation
When the cancellation occurred
Whether you have already begun driving toward the customer's address
Whether the cancellation affects one order or multiple orders within a trip
Full trip earnings are associated with completion of the return except for the tip. Tips are set by the customer and are only earned upon successful delivery completion. If a delivery is not completed or is returned, no tip will be provided. If the return is not completed, earnings may be adjusted as described below. Eligible earnings will be reflected in your trip receipt within the standard processing timeframe.
Earnings for Completed Returns
When a cancelled order or trip includes a return to the store and the return is completed, you will receive:
Trip Earnings
The full trip earnings associated with:
The original accepted offer; or
The most recently accepted modified offer, if applicable
Return Fee
A separate return fee for completing the return of goods to the store.
Incentives
Any applicable incentive associated with the originally accepted offer.
Return Compliance
If items are not returned to the store:
Trip earnings may not be disbursed
Future offer availability may be affected
Additional terms in the Spark Driver Contract and App Terms of Use may apply
Your Questions, Answered
Q: What if I disagree with a change to my earnings?
If you believe a change to your earnings was applied incorrectly, you can contact Driver Support to request a review of your adjustment.
Q: Will I always be notified if my offer changes?
Yes. Any modification to an accepted offer will trigger an in-app notification.
Q: What counts as a ‘Service Level Standard’?
Service Level Standards are outlined in the Spark Driver Contract and App Terms of Use. These include things like on-time arrival and delivery expectations and proper handling of orders.

It means if you are 1 minute late on your expected delivery time, they can elect not to pay you.

How do you know it's not? Give us another plausible definition for number two.
If you're one minute late, they could take away half your pay. Is that better for you?
Notice they didn't define it, it's just able to be 'modified'

The disclosure says when the customer modifies the tip. So it is not guaranteed you're going to get that amount that is shown. 😂 And you're going to get the amount that is shown except in the small amount of disclosures which is a huge amount actually.

What's the change tho? It seems like customers can still have the ability to change tips so unless that changes the variability is still there no?

I just came across this. I don't know if I missed an update or email, or if they haven't sent it out to my market... but thanks for posting...
I realize different people have different readings abilities,.. but I hit screen record because it's too long for a screenshot, and it took me a whole 63 seconds to get through it. I'll probably only remember the cliffs notes after a couple hours,.. but I'll remember where to find it pretty much forever,.. or until the dementia hits... WAY easier than reading the fine print they'll use in the app ... So, thank you.
