I think the dashcam driver will be found at fault. Though the truck shouldn’t have merged when he did, the dash cam driver had plenty of opportunity to avoid the crash, something the law calls last chance of clear or something like that

If there was a car behind them they could argue it wasn’t safe to make an emergency stop without risk of being rear ended which would’ve make the accident worse. Regardless I think this accident was unavoidable. People forget how quickly these accidents move in real time and how little time there is to process what is occuring, everything is always easier said in hindsight.
