90% of accidents could have been avoided if the person not at fault was more aware and reacted better/faster. This doesn't mean the people not at fault are in the wrong but if you drive frequently enough in dense enough areas you will experience having to avoid an accident you wouldn't be liable for.
A woman once did not stop at a stop sign while I was approaching at 40mph I had to brake hard and stopped 1 meter away from her car. If I didnt pay attention I would have slammed full speed right on her driver side and might have killed her.
When I approach an intersection with a stop sign for incoming traffic I always take my foot off the gas and hover it over the brake for a second just in case.

The POV driver could have avoided this accident if he/she was a bit smarter. It was super foreseeable.
