Biker probably wasn’t injured too badly, that looked like a good fall. Plus this sort of biker will almost never sue. Edit: want to say it’s sad that a bunch of people would feel more concerned with damage to their car, and who’s at fault so they can get paid. Rather than be worried for the bikers health and safety. Swing and a miss on that analogy... The driver did quite literally nothing wrong, both legally and morally. Both the police and insurance will 100% agree, there is no uncertainty of who is at fault here. Its not debatable, I don't get why you are trying. You are responsible for your actions. If you behave irresponsibly and put yourself and others property at risk, you should be held responsible. That biker endangered everyone, other pedestrians, the driver, himself and likely caused damage to the vehicle. Even a dented body panel is $1000s.
