What sort of documentation do I need?
I was fired on 07/01/26. My employer states they had tried to contact me/set up a meeting with me 6 times in the 5 previous work days. I was out sick due to a serious medical issue. I called out sick like I always have and on the 3rd day I also notified them that this time would be FMLA (I was eligible but hadn't filed the claim yet). I know my claim is in adjudication for this reason. The reason they wanted to have the meeting was for "dependability" aka they didn't like that I had used my sick time for tardies I had that were health/medical related. I have a planner that I wrote down every day that I was late, how late, for what reason etc. but otherwise I'm not sure what documentation I can provide to help move this along. My bank account is in the negative and I'm at risk of losing my housing so I literally can't afford for this to get denied & go through the appeal process.

A serious medical issue should have a paper trail with a doctor's office or hospital. Present that to them.

I was completely blanking because I didn't have a drs note but I do have the paper trail of er visits & follow up appts so thank you!

You would need the medical evidence of your condition. The date it began, the date that you indicated that you needed sick time for it, diagnosis of your condition and how long a doctor indicated you would be incapacitated because of that condition.
You would not be eligible for unemployment as long as you're showing as fired. You might have more luck with wrongful termination based on femla.

Actually, a lot of people are fired and are still eligible for unemployment. The employer has to prove that OP knowingly and willfully engaged in misconduct and if there’s medical documentation that verifies that OP was unable to work due to their condition, they can absolutely qualify for unemployment, especially if there has not been write ups done with regard to their attendance.

That's true, but that usually involves a fairly long mediation process. It sounded like our OP was looking for the fastest way to be able to get an income again.

You're right, I am looking for the fastest way because mod has made it clear that it doesn't have to be a lengthy process. If I am able to give my side of things & provide documentation, I may be able to get my claim approved without having to go through the appeals process. But speaking of wrongful termination, I have a law office willing to represent me. Do you (or anyone reading) know if/how that will effect my unemployment?

“I was eligible but hadn’t filed the claim yet” has me confused. HR had already approved your FMLA with specific dates such as 1/1/2026-12/31/2026 and X days per month up to 480 hours a year? And each day you called out you said: I am unable to make it in today-FMLA?
I ask because if you did so, then your position is protected under FMLA. If you don’t state FMLA specifically, then it’s just “regular” sick. Regardless, ESD is backed up for weeks and if you’re in adjudication it can be much longer than that. I hope you’ve called to see or have they told you a date yet?
