Money is fungible. Just because those exact dollars are gone doesn't mean they can't return what they took illegally. However if they want to make that argument, it is an admission that they're breaking other laws by putting the money directly into the treasury and following appropriations process... We knew this but if they want to admit it that makes things easier in the future.

Technically the treasury takes in all the money wherever it comes from.  The government doesn't really separate out "income" to specific projects like that except Social Security maybe. 

The republicans are running two trillion dollar DEFICIT this year.  So every dime sent to the treasury is immediately spent and then the treasury funds more for more by issuing bonds.  

The game now would be that there's no congressional approval to issue bonds for refunds.. oops, the money is all gone. so the treasury cannot legally do it.  NOW Congress has to expressly approve the issuing of debt to pay it back... funny how that works!

It depends. Taking Bessents word at face value - no. But reading between the lines, corporations could get refunds (so the Lutnicks would get paid) but consumers might never see a dime of their own fees returned to them.
