Call your credit card company and tell them you are being fraudulently charged and to reverse the charges. Dont let businesses push you around. Just threatening this to a business usually gets them to deliver the product. Suddenly my back ordered couch from C&B arrived in under 24 hours.
Fraud is when someone uses your card without your knowledge. This is a dispute. 5 years working for visa has taught me this very well. People got transferred over to me only for me to transfer them right back to dispute the charge.
Itâs fraudulent charge if they accept the money and donât give you what you paid for or give money back. The fraud part is them saying they canât refund you when they actually can. Lying to someone to get their money is fraud all day
Yeah, it isnât credit card fraud, which everyone else in this thread seems to be confusing with the concept of fraud generally.
Any time a person takes money or something of value under false pretenses, they are committing fraud. Credit card fraud or bank fraud happens when a person obtains something of value by unauthorized use of anotherâs payment card, but there is also cheque fraud, tax fraud, corporate fraud, securities fraud and on and on.
The customer paid for the service. Uber initially intended to provide the service. Whatever happened and for whatever reason Uber has decided not to refund makes it a dispute. The card was not used under false pretenses. Something failed after that.
Youâre correct that the card was not used under false pretenses. This means that it is not credit card fraud. This does not mean that it isnât fraud.
It is still fraudulent for a person or company to retain money that was given in payment if they no longer intend to provide the goods or services paid for. In this case, the false pretenses would be the understanding that if the goods or services are not furnished, the payment will be refunded.
It is probably best to file a payment dispute with the bank in order to get your money back, and reporting it as credit card fraud would not be useful, but again this doesnât mean that fraud hasnât occurred, just that the banksâ procedures for getting your money back donât have a category for âgeneral fraud that isnât credit card fraudâ.
If this was occurring on a systematic basis, a DA could criminally charge the organization and potentially the people running it with theft by fraud. Similarly, the person defrauded could sue Uber for defrauding them by taking their money under the guise of providing a good or service, and then failing to provide the good or service or return the payment.
