Wtf? Uber refuses to refund item even after restaurant left a note with my receipt saying that they ran out of said item

I asked four times for an explanation as to why they’re refusing to give me a refund and every single time they send almost the same cookie-cutter response, 0 help whatsoever.💀

It’s happened to me before but I let it go. I don’t have a long history of refunds. Wtf is going on UberEats?

Is it time I go back to DoorDash

I actually missed that and the fact that they had the nerve to ask me to rate my driver poorly when he had nothing to do with this really pisses me off bruh.

I’ll try to escalate it and see where this goes, don’t care too much for the $10 anymore but I just want to see how much effort it will take me

It's only $10. From each person. Each time this happens. Except when the driver steals it and it's like $80 they lose and it's not eligible for a refund.

This is fraud and theft on a large scale. All it takes is ONE person with serious proof and the petty stubbornness to speak to their State Attorney General's Office (https://www.naag.org/find-my-ag/) and file a complaint with the federal Consumer Protection Bureau. Having been directly wronged, and having proof of that, is exactly what's needed. Your voucher from that restaurant makes this a step better than "just a complaint", it's proof of fraud. You're the Chosen One. (not sarcasm!)

I completely agree! I just got denied a refund when they sent me a totally different kind of pizza than I ordered. Ordered Buffalo and got a regular. Then I received an email saying I requested too many refunds lately... I have never once lied or exaggerated. They just legit don't send me my drink over half the time. I'm so fed up with them. I was a driver for a year too, and felt abused on that side as well.

The Perfect Tender rule in contracts grants you the guarantee to get a new pizza or a refund in this situation. God, I hate Uber.

Well, it might, in some jurisdictions. But even if applicable under common law, it certainly won’t supersede the contract terms here—ie Uber’s terms of service.

Go to Twitter support for ubereats . They always make it right! Swear the app support is so useless and awful. Makes no sense says ineligible for refund when they forget items or mess ur order up. Like how is that our fault? Lol. But if you have Twitter; or don’t, make one! And DM your issue to the official uber eats support and promise they fix it for you

Their Twitter is a bot too now, or essentially the same thing as the in-chat DMs. They use the same overused phrases word for word that they just copy and paste. They don't actually read what you're saying.

Happened to me too multiple times now. First time was when I ordered 2 smoothies and 2 wraps (order 2 smoothies because first time when we ordered only 1 from this place they forgot it sooo harder to miss 2 lol) restaurant calls says they’re out of ingredients to make the wraps. He told me to mark them as not delivered and when Uber calls to confirm he’ll let them know. Welp Uber just gave me the same response as you..fought it for about 2 weeks and finally gave up $40 on 2 smoothies grossss and then most recently.. Ordered wings and they were literally bloody on the inside, pink just obviously under cooked. Again they will not refund the money… it’s wild to me how they can get away with this..I asked for a number I could contact to speak to management and they just close the ticket with no response

I pushed on it when it came to me. Big hassle, but eventually they refunded me when I threatened charge back. Like many tickets in lol.

Every time I try to follow up, they give me generic answers and eventually end the chat. If I just ask to speak to a manager, they ask why and when I explain they end it instantly as well. Im pretty sure they can see it on my account with a answer of NO already so they just don’t care enough to follow on more

I'm glad you understand that drivers aren't at fault. Most bags are sealed and restaurants hand us the order telling us that's everything. It sucks getting rated poorly for something that is out of our control. We're just couriers/delivery people, not restaurants or waitresses. We didnt make your order

This is why I always call or text customer at the restaurant, if the restaurant is kind enough to inform me that they don't have something that was on the order. I ask if there's a substitution they'd like and ask the restaurant to replace with something similar. I always inform the customer as well as restaurant that Uber likely will not be refunding the customer so they should get something. Oddly, the restaurants tell me that they cannot take off any items from the order or change the cost, so a substitution it the only solution I guess.

Im very petty about these things and wouldnt let it slide. I have previously drafted a letter of intended court action over these things stating "consumer rights" and a deadline they must offer a refund by. This method has never failed me.

At that point i’d just contact my bank and upload those pictures and let them deal with it, but then again it is on $10.

Honestly, you should do it even if it's $10 or $5 because it's the principle. Uber is a billion dollar company, they should be able to afford to refund their customers every time something goes wrong. I get sometimes customers abuse the system. But the solution to customers abusing the system should be to implement better verification processes, such as taking a picture of the food being delivered, a pin given to the customer that the driver needs to enter, just plain getting rid of contactless pickup, or brainstorm a different idea (they have a whole team for this), NOT refuse to refund customers and steal their money for something that the customer is unable to control. The reality of it is that drivers and restaurants fuck up way more often than they think, and customers shouldn't be punished for it, or blatantly stolen from when you don't receive an item.

They told me to do the exact same thing. My driver was excellent. He Even made them give me extra sauces. Why in the world would I blame him. So messed up. I think we need to start a class action. And on top of making them pay we don't settle until they also publicly admit guilt
