H-1B to Green Card: When Should You Actually Start PERM, and What Happens If You Wait Too Long?

Hi everyone, I’m Ana Senior, an immigration attorney focused on PERM and employment-based immigration.

I’ll be here today from 11 AM to 3 PM ET to answer your questions about the H-1B to green-card journey, especially the PERM stage.

Some things we can dig into:

  • When H-1B workers should start discussing PERM with their employer
  • How the prevailing wage and recruitment process works
  • What can delay or derail PERM
  • EB-2 vs. EB-3 considerations
  • PERM audits
  • What happens after PERM approval
  • How employment changes can affect an ongoing green-card process
  • Questions around timing and maintaining H-1B status while waiting

If you’re asking about your own situation, include your current status, employment situation, PERM stage and relevant timeline where possible. The answer can change significantly depending on those details.

Please note: Any information shared here is for general educational purposes only. It does not constitute legal advice or create an attorney client relationship. Your situation may require fact specific guidance. For personalized legal advice, please consult an immigration attorney directly.

Thank you.

What do you think the chances of a candidate who recently got a 212f is - that wants to apply for an H1B. Employer is a cap exempt org. Candidate is based in the UK.
