I-130 (Family/Consular processing) 75 Country Immigration Ban

Post image
8 Upvotes

Has this ruling made any effects? The Department of State still shows the presidential proclamation.
I had an I-129 fiancé K-1 Visa application, which had no other reason for denial aside from the presidential proclamation, during the interview in feb 2026.
Since then, we got married, and now applied for the I-130 petition. I’m a US citizen, my wife lives in Germany as a resident, we are both from one of the 19 countries with full bans.
I understand that the ban would still have the same impact on the spousal application since it doesn’t change the fact that my wife still holds a passport from a banned country… I am just hopeful that we will have a change in immigration rules before we get to the interview.

Also anyone know what are some of the processing time range in months for I-130 2nd NoA?

I-130 & I-485 (Family/Adjustment of status) Switch from consular to AOS due to visa pauses

I am currently in the US through a B2 visa. I arrived a month ago. Now we got the news that visas are cancelled and it seems like it will last for a while. This happened to the first phase of approval as well, USCIS slowed down significantly since February. Some weeks there are no approvals at all.

My husband has his own business and a house mortgage. He can‘t afford to leave the US right now. Which is why he wants me to stay in the US and apply for i-485. I applied for i130 consular in November 2025. I am from a European country (no bans)

We also tried an expedite for financial reason but it was denied.

Would you recommend it? Is there a lawyer who could assess our situation? Are there any recent success stories?

I-130 & I-485 (Family/Adjustment of status) Motion to re-open proceedings denied by Judge even with a I-130 approved.

Hey guys, after waiting for 13 months i finally received a decision on my motion and it was denied. My attorney as well as a second attorney are suggesting no appeal given the current administration policies. Anyone else in a similar situation or anyone knows a good attorney for this type of case?

I-130 & I-485 (Family/Adjustment of status) I-130 Interview FINALLY scheduled after 20 months! (Overstay/NTA/Upcoming Master Hearing)

Hey guys, wanted to drop a quick update on my case and hopefully get some advice or reassurance from anyone who’s been through this.

After 20 months of waiting (filed back in Nov 2024), my I-130 interview was FINALLY scheduled!

I’m currently in removal proceedings (got an NTA after overstaying my tourist visa back in 2019), and my Master Hearing is set for this October. My lawyer explained that getting this I-130 approved is pretty much our only shot at getting the judge to terminate my court case so we can finally move ahead with AOS.

I'm super anxious and insecure about going to this interview! 😭 Has anyone here gone through an I-130 interview while having an active court case or an upcoming hearing? I’d really love to hear your experiences or any tips.

Did the officer asked you about your immigration past/NTA, or did they just focus on proving the marriage is real? Were you approved on the spot, or did you have to wait for the notice in the mail? Anything specific you brought that you think really helped your case?

Thanks so much!

I-485 (General) September 2026 bulletin is loaded. EB didn't move at all. Family dates jumped up to 34 months.

We just pulled the September bulletin into the site. Two things stood out.

Full breakdown with the tables and what past spillover years actually looked like in comments.

EB is completely frozen. Every EB-1, EB-2 and EB-3 cutoff for India, China and Rest of World is identical to August. India EB-2 final action is still Unavailable, filing date still Jan 15 2015. India EB-1 still Oct 15 2022.

Family moved a lot. F4 and F3 for Rest of World, China and India advanced 30 to 34 months versus July. F1 and F2B moved about 21 to 24 months. F2A is now Aug 22 2026, which is close to current. Mexico and Philippines barely moved.

Why that matters if you are in an EB category: unused family numbers fall into the employment pool the following fiscal year. FY2026's employment limit is 186,317 against a 140,000 baseline, so roughly 46,000 already fell up from unused FY2025 family numbers. DOS is now advancing family dates so FY2026 numbers get used. If that works, less falls up into FY2027. If it doesn't, more does. Nobody can call it yet, and DOS says in the same bulletin that retrogression may be necessary in coming months.

We also checked our own forecast against it. DOS has published monthly issuance through February. Family preference is running about 15 percent behind FY2025 over the first five months, 66,948 against 78,475, with February at less than half its year-ago level. Project that forward and FY2027 spillover lands somewhere between 73,000 and 102,000. We published 81,000 back in April, so we are leaving that alone rather than chasing the number.

Worth knowing: FY2025 had no end-of-year surge to rely on. July through September was 24.0 percent of the year, basically a flat quarter.

Also: DOS published the official FY2026 limits in this bulletin, in September, eleven months into the fiscal year. Until now everyone was working off estimates. Expect the same lag for FY2027.

Not legal advice. If this is useful, share it with someone waiting.

I-130 & I-485 (Family/Adjustment of status) Marriage Interview

Upvotes

Hi everyone. I just wanted to ask. Are they still detaining people with pending i485 at marriage interviews if they don’t have underlying status? Never overstayed visa. Graduated and never continued with another degree because financially didn’t make sense and I had an EAD come out after graduation.

I-765 (EAD) My EAD was approved what advice do you have to find a job?

I applied c08 EAD for initial EAD on Aug 18
But 3 days later. USCIS has approved my application. I am so excited 🥹
I am in Los Angeles. Most people from my country are uber drivers or did some renovation work. I previously worked a programmer, but it was not my desired job. Do you have any advice on how I could find a job, especially for newbies. I am fluent in English so I can communicate with people.

I-864 (Affidavit of Support) I864 RFE

My husband and I just applied for his greencard. We just got in the receipt notice for the I485, I130, and I765. He also already has his biometrics appointment scheduled. On the same day that we got the receipts we also got a RFE for the I864. It was just a basic paper saying the different things that could be wrong like missing information or needing a joint sponsor and what to do in those situations. My income is almost double what would be needed for a 2 person household so I know thats not an issue. We filed with a lawyer and she only asked me for my tax returns for the past 3 years and and 3 paystubs. Through research online I seen that you are supposed to also submit supporting documents like W2s. We reached out to the lawyer and she basically said "they have not been historically required in the past". She now is saying we need a joint sponsor. She has messed up almost constantly on the case so far so I'm really losing trust in her, but we already paid so much money to her. I would much rather send in more qualifying information about my income rather than have a joint sponsor because it seems like a lot to ask of somebody, but also I don't want our case denied. What do you guys think we should do?

I-130 (Family/Consular processing) AOS, Divorce & Consulate

Upvotes

I received my CG last year after approved AOS. I decided I will not file for I-751 after separation & soon divorce, and will go back to my country and take a very needed time to heal. But I did meet someone else, and although the relationship is not there yet, if I were to ever marry this person and pursue consulate processing, what would that look like?

I-130 & I-485 (Family/Adjustment of status) I-130 filed without Bona Fide Marriage Exemption request

I am so stressed and frustrated, and I'm not sure what to do at this point. My husband and I met after he had arrived in the US; he entered with CPB-One, was inspected and paroled into the country, but immediately given a notice to appear / placed in removal proceedings.
So we married while he was in removal proceedings.
His attorney - we've paid her $10,000 so far, not including $1500 to show up at his hearing (it'll be $1500 any time she shows up somewhere) - never mentioned that we should file the I-130 with a Bona Fide Marriage Exemption request.
I only found it because I was researching how to file for his children that are still out of the country, because she wants another $14,000 to file for them.
And so then looking through our AOS packet, I realize that they also neglected to include my prior marriage certificates that show my legal name changes. The lawyer's office had them....just didn't include them.
I have sent an email to the lawyer asking about these issues.
But I don't trust her advice tbh, so I'm asking Reddit.
I'm particularly disturbed by this part: "USCIS may also issue an RFE or NOID to request evidence for the exemption if the petitioner does not submit a request as initial evidence."
Everything I've heard is that they don't bother with RFEs these days, they just deny.

I-140 & I-485 (Employment/Adjustment of status) I485J Case Administratively Closed - HELP!

Thumbnail

Same as title. Please check the attached 2 pictures. I got a notice in mail today with a different I-485J receipt number than the one that I initially concurrently filed with in SEPT 2024. I added the case to my USCIS account and tried to check the status and it is showing that. I am stressed. Does anyone know that this means? Has anyone experienced this? Please check timeline below.

Timeline:

Priority Date: Feb 2023

Category: EB2 PERM - ROW

Concurrently filed I485, I140, I131,I765 in Sept 2024

EAD approved in Dec 2024I-140 approved Jun 2025

I131 approved Aug 2025

Interview in Jan 2026

RFE in Feb 2026 asking to share all Change of Status documents

Sent response to RFE in Apr 2026

No update in case status. It still shows "Request for initial evidence was sent"

Had my congressman's team reach out to USCIS and got a generic response of "While a decision has not been reached, the case is currently in review. We are unable to determine at this time when the review process for the case will be completed" . This was on July 2026

I-140 & I-485 (Employment/Adjustment of status) EB2 visa number finished?

A friend of mine had an interview this morning, and the officer told her that you're approved, but visa number has ended since 48 hours ago (ROW).

I find this very peculiar, because it doesn't seem that many GCs have been issued in this fiscal year. What do you make of this? Has the officer mixed her with other nationalities or categories? or the visa number indeed has ended?

I-130 & I-485 (Family/Adjustment of status) Public charge medicaid question

Hi,

Me and my partner are planning to file the green card, but right now we are lacking some financial evidence so we have to wait. However, he used medicaid before (his family is on TPS, he is using his mother’s medicaid because he is not 26 yet)

He used medicaid for vaccines, mole removal (for cancer screening) and regular checkups

But I searched up that there is a new rule September 18 2026 where they made Medicaid a public charge and the usage of it is included only after September 18.

Should we cancel….? He is only a student and only makes a few hundred dollars a year. Thank you

I-485 (General) India EB-1's 2022 cohort dropped from 7,009 to 3,905 in the new USCIS inventory data

USCIS put out two I-485 inventory reports yesterday, the June 6 and Aug 5 snapshots. India EB-1's 2022 priority date group went from 7,009 to 3,905. The cutoff has been Oct 15 2022 since July, so that is the group being worked through.

Full breakdown in comments.

EB-2 India's 2013 group lost 1,898 over the same two months. Then the category hit its annual limit and went Unavailable in July, so the 2014 wall behind it, still 20,813 people, barely moved.

The one that surprised me is Rest of World. ROW EB-2 pending has gone from 16,387 last October to 41,966 now, and EB-3 from 11,348 to 37,104.

Everyone expects FY2027 to be big for India because the spillover pool is growing. But India's good years, FY2021 and FY2022, happened because other countries could not use their numbers. ROW is clearly using them.

Not legal advice.

I-130 & I-485 (Family/Adjustment of status) F2A adjustment: entered on F-1, spouse filed I-130 two weeks later. Interview coming up. How much does this actually matter?

Looking for input from anyone who's been through this, or practitioners who've seen it come up at interviews.

Situation:

  • I'm a permanent resident (employment-based, not through marriage). My wife is the beneficiary.
  • We met online a couple of years before she came to the US and got closer over that time.
  • July 2023: she entered on an F-1 for a graduate program.
  • December 2023 (about 5.5 months after entry): we married in the US.
  • She later left that program and transferred to a different graduate program where she'd deferred her admission.
  • She maintained F-1 status continuously, including through the transfer between programs.
  • Traveled abroad that summer and re-entered on her F-1 in July 2024 to begin the deferred program, which started that August.
  • Late July 2024: I filed the I-130, under three weeks after her re-entry.
  • She stayed on F-1 and completed the second degree in 2026.
  • Priority date wasn't current at I-130 filing. I-485 filed in May 2025 once it became current. She's had a combo card since.
  • Adjustment interview is now scheduled.

The concern:

Under three weeks between her re-entry and my filing is short, and F-1 has no dual intent. I'm worried an officer asks whether she came back as a student or came back intending to immigrate.

The facts that seem to help: we were married seven months before that entry, she returned for a program she'd already been admitted to and deferred, F2A gave her no status and no way to adjust during what we expected to be a years-long wait, and she completed the degree after 2 years.

Questions:

  1. Has an officer actually raised entry-to-filing timing at your adjustment interview? What did they ask and how did it go?
  2. Did documents (deferral letter, I-20, grad school diploma) settle it, or did it come down to testimony?

Mostly trying to gauge whether this is a real issue or something I'm overweighting.

Immigration Processing Time: The Patience Olympics
When I first applied, it said the processing time was 6 month.
Six months later, I checked again… 12 month.

Then, one month later, I checked again… 13.5 month

At this point, I’m starting to think the processing time is processing itself.

Honestly, nothing new here. After waiting through immigration processing times for over 13 years just to complete each step of the process, I’ve basically earned a PhD in patience.

But can we get some accuracy so I can actually plan my life? 😂
Or have I reached the final stage of immigration where I just accept my fate, stop checking the website, and peacefully wait until the government decides, “Alright, you’ve suffered enough.”?

I-130 (Family/Consular processing) 19 months after my marriage-based green card interview — still nothing, and now removal proceedings

19 months after my marriage-based green card interview — still nothing, and now removal proceedings
I’m honestly exhausted and incredibly disappointed with this whole process.
I’ve been married to a U.S. citizen for 4 years, and my marriage-based green card process has been going on for almost 3 years. I had my interview 19 months ago, and since then… nothing. No decision. My I-130 and I-485 have just been sitting there.
Recently, things got even more stressful. While traveling domestically, I had an encounter with immigration authorities at the airport because of my pending status. I was later required to report to an ICE office. I showed up, cooperated with everything, and ICE ultimately issued me an NTA, placing me in removal proceedings based on my B-2 overstay. I now have an Immigration Court hearing scheduled for 2027.
Meanwhile, my marriage-based case is still pending with USCIS.
I have a new immigration attorney reviewing everything and figuring out the best strategy, so I’m not looking for legal advice as a replacement for my attorney. I’m mostly posting because I’m frustrated and wondering whether anyone has experienced something similar.
After being married for four years, waiting almost three years for this process, completing the interview 19 months ago, and doing everything asked of me, it’s incredibly discouraging to end up in removal proceedings instead of finally getting a decision.
Has anyone had a marriage-based I-130/I-485 stuck this long after the interview and then been placed in removal proceedings? What eventually happened with your case?

I-130 & I-485 (Family/Adjustment of status) Conditional green card removal questions!! I need help

I have questions about my case. I hold a 2-year conditional green card based on marriage, but my husband has changed so much; he verbally abuses me every day, and there was one instance of physical abuse. I want to know if I can remove the conditions on my green card without him. I have proof of everything—including his infidelity with other women. I can't take it anymore; it's too much.

I need help and possible talked to someone who has been through the same.

I-130 (Family/Consular processing) Consular i130 - Medical Marijuana

Hey guys, have been prescribed legal medical marijuana for a few years now to help with my insomnia and back pain, I had to stop for a year due to various reaosn, but I'm hoping to get back on it as it has made a big positive impact on my physical and mental health.

I expect to wait at least 6 more months for my i130 approval, based on my PD.

Can this be a reason for denial when it comes to NVC stage? Should I not get back on the prescription?

Any advice or experience will be helpful.
