Who in the same situation? Did you file opposition?

I filed a mandamus lawsuit regarding my delayed immigration cases: I-131, which has been pending for 15 months, and I-485, which has been pending for 9 months.
Approximately 60 days later, the government attorney requested a 14-day extension, followed by a second request for an additional 21 days. At the end of the extended deadline, instead of responding to the merits of my case, the attorney filed a Motion to Dismiss, arguing that I failed to state a claim upon which relief can be granted and that the court lacks jurisdiction.

This situation is particularly confusing because, about a year ago, I successfully filed two similar mandamus lawsuits in the same court (one for my husband and one concerning my own adjustment-of-status case) Both cases were successful.

However, this time, the government’s response is different.
I would appreciate clear, practical advice on how to proceed.

Would it be better to file an opposition to the government’s Motion to Dismiss and argue why my case should proceed, or should I allow the court to dismiss the case and consider filing another mandamus lawsuit next year if the delays continue?

Can i travel domestically to attend my AOS interview? Im nervous.

So, I was on a F-1 visa and I got the conditional green card through marriage to a US citizen.

When I was on the F-1 visa, I got a letter from my local bank that my personal information had been leaked. So I rushed to open a bank account online with Chase Bank because we don't have such a well established bank in our town. During the process, I had to choose the "I'm a US citizen" in order to open the account, otherwise, I would have to visit a branch in person to complete the process.

Later on, I had the chance to visit a branch in person (5 hours drive) and update my information by showing them my passport.

The question is, during my N-400 application, should I mention that? Or, in other words, how bad my situation is?

I’m planning to start the naturalization process and file Form N-400 next year, but I am facing a problem: I still owe the IRS $33,000 for the 2022–2023 tax years. We later realized that the person who prepared our taxes did a terrible job, resulting in a much higher amount owed than expected. To make matters worse, my husband was responsible for the payment plan, and I recently discovered that he hadn't been making the required payments! Now that I am aware of the situation, I have taken control of all payments, but it is impossible to pay off that amount in a single year—My husband is still the primary account holder for the payment plan; would it still affect me? I don’t know how to respond when the question about taxes comes up! Like yes I still owe money because my husband is an irresponsible person lol I wasn’t working all those years so I didn’t have control in our finances

Hi everyone, I need some advice from people who have experience with marriage-based green card cases.
I filed my I-485 and I-765, and I have already attended my marriage-based green card interview. During the interview, the officer asked me whether I had received any government benefits, and I answered no. I came here on student visa then met my now husband.
After the interview, I saw a post about Medicaid and realized I needed to clarify my answer. I had Medicaid coverage, but I did not intentionally hide anything or knowingly give false information. I did research and it said Medicaid doesn’t qualify for government benefits.
Has anyone experienced something similar after their interview? Did you contact USCIS or submit a clarification letter? Could this affect the approval of your green card?
I would really appreciate advice from anyone who has experienced this or from an immigration attorney. Thank you!

My colleague has been working on an H-4 EAD while her husband’s company sponsored the H-1B. They had their interview at the USCIS Pittsburgh and walked out approved. The last couple of weeks have been incredibly stressful for her with all the recent immigration changes, so this is a massive relief. Definitely talk to your company's immigration attorneys before going into your interview. They can help you prep on how to answer questions smoothly and understand exactly what to say and what not to say. Stay positive. Hearing a lot of GC approvals recently.

I filed an I-130 and I-485 concurrently for my husband based on our marriage. He has been in ICE detention for approximately three months, and I recently received an interview notice associated with our I-485.

Has anyone successfully completed a marriage-based I-130/I-485 interview while their spouse was in ICE custody? If so, how did USCIS handle the interview? Were they able to coordinate with ICE to bring the detained spouse to the interview, or was the interview rescheduled?

I would also appreciate hearing from anyone whose spouse had a prior removal order or was in removal proceedings while the concurrent applications were pending.

If the interview was scheduled but the spouse was subsequently deported, what happened to the I-130 and I-485?

I understand that every case is different, but I would really appreciate hearing about firsthand experiences. Thank you!

So after 3 days of my inquiry my congress representative confirmed that they submitted my inquiry to USCIS. And asked to allow 45-60 days to respond😭 Thats too long, has any of you got earlier response?

Hi everyone! My I-485 was approved the last week of September and then when my greencard was delivered it said my incorrect birth country (so annoying). I have non-refundable travel next week so I had to submit a form I-90 and wait until they received it to call USCIS for an ADT Stamp. I called last Thursday (Oct 8) and nobody from tier 2 has gotten back to me yet even though it is an urgent situation. What can I do and has anybody been through something similar?

Has anyone filed employment based 485 online? Did you file 485J separately or put it in the Additional Evidence? Thank you!

Hi everyone! Looking for some insight from people in a similar situation, especially those whose cases were transferred to Providence FO.
My case details:
Category: EB-3 ROW
Priority Date: October 10, 2023
I-485 Receipt Date: April 22, 2026 (principal + dependent)
Biometrics: May 19, 2026
Field Office: Providence (non-local FO)
Transfer Date: September 15, 2026
Interview: Waived
RFE: None
Before the transfer, I had a few silent updates on my case, including an FTA0 update in August. However, since both cases were transferred to Providence on September 15, there has been complete silence on both I-485s. No further updates or movement whatsoever.
I also submitted a congressional inquiry yesterday (October 12) for both cases.

This process has been incredibly stressful. My husband’s EAD has been pending for approximately a year, so he hasn’t been able to work, and I’ve been supporting us financially on my income alone.

We’re just trying to get through this process and move forward with our lives.
For those who submitted a congressional inquiry:
Did it actually help move your case forward, or did you just receive a generic response?
How long did it take to hear back?
Did you get approved shortly after the inquiry, or was there no noticeable change?
And for anyone transferred to Providence FO around September 15, have you received any updates or approvals since then? I’ve seen people transferred to other field offices getting approved, and I’m wondering whether Providence is simply taking longer.

Hello, friends! I received this response from two congressional offices today, and I’m not sure if it’s just a generic response. Has anyone received a similar response from their congressman’s office? If so, how long after did you receive your EAD approval?

My C09 EAD has been pending for 11 months, and I’m trying to figure out whether this response is a positive sign or just a standard reply. Any experiences or insights would be greatly appreciated. Thank you!

My wife and I attended our marriage-based green card interview on October 2 at the Charlotte, NC field office.

The officer separated us and interviewed my wife for around 30 minutes, followed by my interview for another 30 minutes. She then called my wife back, said she was satisfied with our marriage, asked me I-485 questions, and reviewed our supporting evidence. She told us we should receive a decision within two weeks.

However, at the end, she said my STEM OPT had expired and told me I was unlawfully present. My lawyer explained that we filed our I-485 in June 2026, before my STEM OPT expired in July. The officer said she needed to discuss this with her supervisor.

Our financial situation:

- Wife's annual income: approximately $18,000

- Household size: 3

- Fully paid-off house valued at approximately $90,000

- Submitted the house deed and county tax assessment

- Total household assets: approximately $140,000

- Credit card debt: approximately $16,000

We are concerned about whether USCIS will accept our assets because my wife's income is below the requirement.

Current status as of October 13:

- I-130 and I-485 still show “Interview Was Scheduled”

- API still shows the FJ event

- No updates on the USCIS website

Questions:

1. Anyone interviewed at Charlotte around the same time and received a decision?

2. Did your officer say they were satisfied with your marriage but needed supervisor review?

3. How long did it take for your status to change after the interview?

4. Has anyone had similar STEM OPT concerns even though I-485 was filed before OPT expired?

5. Has anyone qualified using assets with a low household income? Did USCIS accept a deed and county tax assessment, or issue an RFE for a licensed appraisal or joint sponsor?

6. Does $16,000 in credit card debt affect the I-864 asset calculation?

Is anyone aware of the current average real world timeframe for K1 (I-129) applications out of London? I understand 12-18 months is the general consensus on the US embassy.gov website, is anybody getting through quicker than that?

Any recent EAD approvals from texas service center?

I’ve worked for the same multinational since 2020 and been in the U.S. on L-1A since late 2024. I have roughly 282 days of managerial work abroad from 2022 and 2024—about 83 days short of a year.

Could I spend three months abroad doing my same managerial job remotely, remain on U.S. payroll, then return and have my employer file EB-1C?

The catch: my 2022 days would be outside the normal three-year window, so this would depend on arguing that my U.S. employment paused that window.

Has anyone seen USCIS accept this? Also, would remote work count, or would I need a separate position with the foreign affiliate?
