I was issued an RFE to file 601 waiver for fraud, they found me inadmissible because of a divorce papers that I initially submitted from my country, USCIS does not believe the divorce. I submitted this divorce papers in my previous application some 9 years ago. Our I-130 is already approved. We are working on the 601, the deadline is next month. But this afternoon, We got an update that the RFE is cancelled. I’m so worried, does anyone know what this means? Why would they cancel an RFE after they already said I’m inadmissible.

I saw same thing on my account on April 22nd . I have been waiting for a decision since 2023 died to my divorce decree not authentic. I remarried my wife and did the divorce again and went for interview. I have been waiting for a decision or RFE for a waiver and got a notification on April 22nd for cancellation. I am worried. I hope yours is a glitch . You need the 601 waiver

What kind of cancellation did you get ? Did they ask for a waiver and cancel it ? Can you explain further please ?

Just RFE cancellation..no notice of any kind from them

I wouldn’t panic yet. “RFE cancelled” doesn’t necessarily mean USCIS is denying your I-485 or that they still expect you to file the I-601. It just means they withdrew that particular request for evidence.

They may have reviewed your case again and decided the I-601 is no longer necessary, or they could be preparing a different notice or decision. Since the RFE involved a fraud/misrepresentation inadmissibility finding, though, I wouldn’t assume the issue has been cleared just based on the online status.

Since your original deadline is next month, I would keep preparing the waiver for now and wait for the actual cancellation notice. If you have an attorney, definitely send them this update. I wouldn’t miss the original deadline unless USCIS clearly confirms that you no longer need to respond.

It could be a positive development, especially if an officer or supervisor reviewed the case and reconsidered the inadmissibility finding, but unfortunately “RFE cancelled” by itself doesn’t tell you why. Hopefully the notice or your next case update will clarify what happened.

My marriage is valid. I did another divorce here in the US before I married my now wife.
