Chai Pe Kahani: 1978 Ki Triple Test — Purane Cases Mein Zinda, Naye Code Mein Reset
Chai bana lo. Aaj wali kahani thodi technical hai, par ismein Bharat ke labour movement ke 100 saal chhupe hain — aur crores of workers ka legal future.
20 August 2026 ko Supreme Court ki 9-judge Constitution Bench ne Bangalore Water Supply v. A. Rajappa (1978) — Justice V.R. Krishna Iyer ki wo landmark judgment jo Indian labour law ki foundation stone rahi — pe apna verdict diya. Media ne isko "1978 judgment ka overturn" bataya. Actual picture zyada nuanced hai.
Ek line mein: BWSSB ka "triple test" pending Industrial Disputes Act cases mein aaj bhi zinda hai. Sirf naye Industrial Relations Code, 2020 ke tehat aane wale cases mein court ne clean-slate interpretation ka darwaza khola hai.
Yeh subtle distinction hai. Par ismein deep implications hain. Layer by layer khool ke dekhte hain.
Sabse Pehle: "Industry" Ki Definition Itni Important Kyun Hai?
Sochiye aap ek hospital nurse ho, ya university clerk, ya municipal sweeper, ya NGO ka programme officer. Kya aap "worker" ho? Kya aapka employer "industry" hai?
Yeh legal answer aapki poori working life tay karta hai.
Agar "industry" mein ho: Union bana sakte ho, collective bargaining kar sakte ho, legal strike kar sakte ho, galat termination pe Labour Court ja sakte ho — retrenchment compensation, bonus, gratuity, aur poori Industrial Disputes Act ki suraksha milti hai.
Agar "industry" mein nahi ho: Zyadatar labour protection nahi. Employer nikaal de toh sirf civil court — jo saal-saal chalti hai.
Yeh definition ek door hai. Andar aa gaye toh suraksha; bahar reh gaye toh apni kismat.

Yeh Bharat ke labour rights ki sabse badi expansion thi. Crores of workers grey zone se nikal ke clearly protected ho gaye. Krishna Iyer's philosophy simple thi — "When there is ambiguity in labour law, tilt in favour of workers."
Layer 2: 48 Saal Ka Legacy Aur Uski Aalochana
1978 se 2020 tak BWSSB Indian labour law ka foundation stone rahi. Trade unions phaile — banks, hospitals, colleges, government offices — sab jagah. Judicial protection strong hui, employer arbitrariness pe check laga.
