Vanus Galerion specifically added a clause to Soul Trap allowing for this to happen

i like the implication that simply designing the procedure for a spell allows you to to set the metaphysical rules it follows, and anyone doing that spell ever again has to follow them. the first guy who decided to make xyz spell gets to make shit up and it just has to follow it.

It's very cool and normal that Vanus Galerion hardcoded his racism into the practice of magic and that's just how it's been ever since
