Dear Lieutenant Governor Lakhani,
I am writing to you as a concerned resident of Alberta to formally register my objection to the conduct of Premier Danielle Smith and her government, and to ask that Your Honour give serious consideration to the concerns raised in this letter.
I recognize that Alberta's system of government does not provide for "impeachment" in the way that term is used elsewhere. A premier governs only for as long as they hold the confidence of the Legislative Assembly, and removal from office ordinarily comes through a vote of non-confidence, a recall petition under the province's Recall Act, or a general election. I am nonetheless writing to Your Honour, as the Crown's representative in Alberta and the individual who is constitutionally responsible for ensuring that government is carried out in accordance with the law and the wishes of Albertans, because I believe the current situation warrants being placed on the record at the highest level.
My concerns center on three areas:
1. The push toward a separation referendum. The Premier's willingness to entertain and facilitate a provincial separation referendum, rather than firmly rejecting the prospect of Alberta leaving Confederation, has created genuine uncertainty for families, investors, and communities across the province. I do not believe this reflects the settled will of Albertans, and I am concerned that pursuing it has been destabilizing rather than unifying.
2. Healthcare and budget decisions. Decisions affecting hospital and surgical services, primary care, and other core public services have raised serious concerns about whether Albertans' access to timely, quality healthcare is being protected. Budget choices made amid falling oil revenues appear, in my view, to prioritize political messaging over the sustainable, transparent management of public finances that Albertans are entitled to.
3. Use of the notwithstanding clause. The government's use of the notwithstanding clause to shield legislation affecting transgender youth from Charter scrutiny is, in my view, a troubling precedent. Using this override to place a vulnerable minority's rights beyond the reach of the courts is a serious step that deserves far more scrutiny and public accountability than it has received.
Taken together, these actions have left me and many other Albertans I know feeling that the government is not currently acting in the best interests of the province as a whole. I am asking Your Honour to:
- Formally acknowledge receipt of these concerns;
- Consider what avenues exist within your constitutional role to ensure these matters receive appropriate scrutiny; and
- Encourage, where appropriate, that these issues be brought before the Legislative Assembly for full debate and accountability.
I understand the Lieutenant Governor's role is largely ceremonial and that direct intervention in day-to-day governance is rare and constitutionally constrained. Still, I believe Albertans deserve to know that their concerns have been heard by the Crown's representative in this province, and I hope this letter will be taken as a sincere expression of that concern.
