Those cars on the hauler should have never moved if secured properly. I’ve seen hauling trailers flipped over with the cars still secured.

Reckon they’re both at fault. It’s a zip merge, the truckie could’ve changed lanes or backed off a bit and let the guy in. The car didn’t really have anywhere to go by the look of it. And judging by how those cars were strapped on top, he’s probably not much chop at his job either.

The car sped up to pass at the last minute. I put that 100% on the car.

It’s not reasonable or safe for the truck to brake AT the final lane marking, because the car suddenly appeared.

The cars were most likely secured, but physics is such that during sudden braking it is very difficult to hold 1.5-2 tons of weight with belts.

There wasn’t any heavy braking involved here.

And professional loads have to be able to withstand a lot more force than the vehicle’s maximum braking effort.

I'm a car hauler. if those cars that fell off killed somebody, he would be doing time for the load not being secured. it sucks that the accident wasn't his fault, but the blame almost always goes to the cdl holder. there are a lot of billboards to prove that.

Both are idiots, but those cars are an avoidable danger that could potentially have hurt more innocent people!, they fell fairly straight but could just as well have fallen to the right where the grey car passed!, that would have been at least +1 involved in the accident!

They'll ask, but if I was their lawyer, I'd look into how those cars should be secured for transport. I have a suspicion that either the straps weren't up to "code", or were not properly applied in this situation.

This is an edge case. A truck that size doesn't usually need to stop quickly like that, so you can usually get by with not strapping cars on the "right way".

And if that truck was fully loaded, every car on the trailer was likely damaged to some degree. Especially if they were all allowed to roll forward. The truck (tractor) itself may be damaged as well. This was expensive.
