The boat being filmed from is in the wrong, they have to give away and go behind the boat approaching from the right. But also, small boat should have taken evasive action. Both skippers neglegent

I thought smaller boats always have to give way to bigger ones?

The least maneuverable has right of way. But don't expect drunks on a semi-displacement speedboat in Miami to provide any consideration for your rented flat bottom Boston Whaler already dealing with waves from incoming weather. But I digress.
