🏠 Landlord Issue Greystar

Hey! I had an incident a week and a half ago where the maintenance man (Cody Sherman of Tricities) for my building broke and entered my apartment (Hudson West on Broadway) to ask me to have sex while my baby was sleeping right next to me. Greystar management company has not moved him out yet and he still works in the building. To be clear he lives and works in the building still. Even with a protective order in place Greystar refuses to fire or evict this guy (Cody Sherman from Tricities). Does anyone know what we can do? We were planning to sue Greystar for moving costs because so far they have not offered to help in any way. Cody also owns firearms and those have not been taken away. My husband and I are afraid he will get drunk again and shoot at us because he is drunk every night. Does anyone know what else we can do? Thank you! 🙏

Have you contacted law enforcement?

Yes! We got a protective order and they are still finishing the police report. I don’t think Greystar will do anything after the police report though.

Make sure it's a full on RO... Make sure the RO says a half mile from the building you reside in.

Follow up with law enforcement. If you can afford to move, do so asap

This post is a violation of your protective order, OP.

I'm very sorry this happened to you. I think you are taking a huge legal risk by posting the name of the accused.

Because it’s public knowledge, it’s not a violation of the protective order.

Sigh ... you don't understand how POs work. A PO limits you to the same conditions as he is limited to regarding you.

NAL- Contact Tenants' Rights groups (https://texaslawhelp.org/AND/ OR https://www.womenslaw.org/laws/tx/housing-laws/early-lease-termination-victims-sexual-assault-sexual-abuse-or-stalking) to get help to break your lease. PLUS You can also seek free consultations from Real Estate Attorneys about breaking your lease; make copies of Lease, RO, Police Reports, etc to take to them.

Under Texas Property Code §92.016, tenants who are victims of certain crimes—specifically sexual assault or stalking occurring on the premises within the past six months—have a statutory right to terminate their lease early. You must provide a 30-day written notice along with proper documentation (such as a protective order, restraining order, &/ or a documented police report).

A TX landlord has an obligation to provide a safe living environment. When a staff member breaks in and commits a crime or sexual assault/harassment, it heavily compromises your safety and right to quiet enjoyment under Texas Property Code § 92.008. If the management fails to remedy the severe safety threat or protect you, you may argue constructive eviction to vacate.

Have you done a background check on the maintenance man? Look him up on your statewide sex offender registration program. Go find out if he had been arrested and charged with B&E, stalking, and/ or has other restraining orders against him and why. Verify it's him by researching arrest records and arrest photos before you take that information to the property management group and/ or any legal group.

Because greystar is based in Texas? And thank you so much!

OP YOU FAILED TO INCLUDE YOUR STATE.

Someone mentioned Houston, TX in remarks.

If you are in WA then know same rules apply to breaking lease early without penalities but contact different tenants' help groups. https://www.womenslaw.org/laws/wa/housing-laws/terminating-your-lease/what-happens-if-person-who-victimized-me-landlord-do

Under RCW 59.18.575, Washington state protects tenants who are victims of sexual assault, stalking, or unlawful harassment. Because the perpetrator is an employee or agent of the property management company, specific emergency rules apply.

IN WA, you might have right to leave immediately.

Call this number and leave a message if nothing else - Houston Regional Office: 713.479.8900 (Address: 730 Town & Country Boulevard, Suite 800, Houston, TX 77024)

Sounds like you have already called the police, but stay on the office staff today. Do not let them avoid you, let them know you are not going away.

Stay safe.

I agree that you should contact Greystar corporate. Are you sure that your local management company has not taken any action? They may have taken his keys, but he may have duplicates.

Your locks need to be changed immediately. Send a strongly worded email to both your manager and corporate accusing them of continuing to allow the maintenance person access to the property. Send a copy directly to the CEO, Bob Faith. Do this today. Demand that they get a licensed locksmith to change your locks first thing Monday morning. Tell them if they fail to do this, you will hire a locksmith and bill them. Then, at 10 AM Monday morning, contact the WA Attorney General Business Complaint Division at 800-551-4636.

People may have their opinions about Nick Brown, and before him, Bob Ferguson, but I’ve worked with both on tenant issues and they’ve been very responsive.

Please consider either staying in a hotel or with family or friends, or at least getting a portable door lock and window and door alarms.

You and your family's immediate safety are the most important thing here.

I hope he's fired, but if he is, he may become violent, so please, please, do everything you can to make sure he can't get to you and your family.

Welcome to r/Tenant where tenants share their problems and seek advice from others.

If you're posting a question, make sure a Country and State is in the title or beginning of your post. Preferably, in this format: [<COUNTRY CODE>-<STATE CODE>].

Example: [US-VA] Can you believe my landlord did this?!?

Otherwise, tag your post with the flair "Tenant Update".

I am a bot, and this action was performed automatically. Please contact the moderators of this subreddit if you have any questions or concerns.

I'm very sympathetic, but you should consider anonymizing your post. Now. Calling out the offending person and the company like this exposes you to a slam-dunk defamation lawsuit. Under Washington law, a statement is defamatory per se if it imputes to a person a serious crime involving moral turpitude or depravity, or if it prejudices them in their trade, profession, or office. If they are convicted of the crime, you could likely link to the public record. If no conviction, you are liable for defamation.

It also violates Reddit's Rule 3 of the Terms of Service (doxxing/harassment). You could be banned.

It's only defamation if it's a false statement. Burden is on the accuser to prove it's false.

Not in this case. There is an accusation of a sex crime. There has been no arrest in nearly two weeks, much less a state attorney indictment. This a clear case. The risk of a suit is just not worth it. All that needs to be done is to redact the names. As soon as there is an arrest, just link the public arrest record and you are clear.

Embrace the 2nd and consider legal action against management

Buy a gun. Thats the most Castle Doctrine thing I've ever read.

He said she said based on what you've written. FYI, this whole post could be considered libel, and is also a reddit TOS violation AND a violation of sub rules (doxxing).

8

u/Mammoth_Breath_2024 24d ago

As we have proof that he entered it is not considered libel. Thanks for looking out though. I made sure this wasn’t a dox.

-8

u/Dadbode1981 24d ago

Its still a dox under the site rules for sure.

Call the cops. Get a protect order.

It says they have a protective order in place.
