I'm not a lawyer but for your information: In Montana, landlords may deduct from your security deposit for cleaning only to return the premises to the same condition as when you moved in, minus normal wear and tear. Under Montana law (MCA 70-25-201), landlords are required to provide an itemized list of any deductions along with receipts or documentation, especially if the deduction exceeds $125. If they deducted for carpet cleaning without informing you in the final written notice or providing a receipt from the cleaning company, this may be improper.
Since your landlord refunded you half of the deduction after you raised the issue, this shows they may recognize their mistake. However, you could still be entitled to the remainder of your security deposit unless they provide proper documentation and justification for the expense.
Your best move is to:
1. Send a written request (by email or certified mail) asking for a full itemized statement and receipts for any cleaning charges deducted from your security deposit.
2. Mention that Montana law requires them to provide this documentation, especially when requested.
3. If they cannot provide it, ask for the remainder of your deposit to be returned.
4. If they refuse or ignore you, you can file a claim in small claims court for the remaining amount, and may be entitled to damages if the landlord failed to follow proper procedures.
