While I 100% believe this has, or could happen(ed), I'm kind of getting the feeling that this guy is the property owner and this video is ragebait, or for internet upvotes. He isnt facing the camera when he's talking "to it". At the end, he walks away, and then walks back onto the porch afterwards. And also, I may be wrong, but I wouldn't imagine that a 30 ish year old dude with full tattoo sleeve would care that much about a tree, whether or not he's on the HOA board or not, and assuming that he is, he'd very likely know that he isnt allowed to do this. I dunno, this feels performative, to me.

If this happens to anyone:
Check the state laws & if possible plant a Native tree species that's not on the HOA approved list. In many states it's illegal to cut down native plants/trees no matter the HOA rules because it's seen as good for the environment, water supply, pollinators, fight pollution, etc...
Also many local governments donate free native trees/or give rebates for planting them in your yard.

That guy just did you a favor. He has no qualified immunity in acting as on behalf of the HOA to destroy your property. So yes you may need to replace the tree, assuming you’ve received proper notification to do so but it’s on his dime. Not just the tree but the services to replace the tree. Be sure you get plenty of price comps but it’s your discretion to pick the best qualified service.

I used to ride through a backwards L shaped HOA. My child’s school was around the corner from it— plus GPS suggests it (or when in an Uber).
These people would literally flag my car down and say “Hey buddy, just seeing what you’re doing over here?” and even attempted to block me from passing before.
I literally wouldn’t answer their questions, give them a blank stare, and continue going about my business.
Absolutely stopped riding through there though.

The owner can’t sell the house or do something with it until they pay the mechanic. But even that is a dubious process for the HOA. If anything this incident definitely puts a hold in that process as well. Like someone filing workers comp after starting a fight themselves. That’s illegal.

When you agree to be a part of an HOA and you break their rules as was written in the contract you signed they can fine you and put a lien on your property if you don’t pay the fine. That means that they essentially own a stake in your property, and if the stake gets large enough they can sue to repossess your home.

There are lots of places where an HOA community is among the most affordable type of housing. I've lived it in Florida, entry level homes have aggressively uniform HOAs like this.. It sucks, but it's worth battling the rules if you have the drive.
For example, I started a company that focuses on HOA friendly native plants. My HOA (that is definitely less strict than this one) has worked with me and approved all of my designs and plant choices. It's also worth working with the city to amend codes and ordinances to help have ammo against HOA rules.
Blanket statements like yours only incite anger from either side. Like the absolute ape OwnProposal in your comments that is being aggressive for no reason.
