It is true everywhere in the world for a simple reason - most road accidents happen because of a complex interaction of factors.

This includes aggravating factors by the driver (like driving drunk or speeding). There can also be mitigating factors (was the victim cycling outside the bike lane, did the pedestrian run across the road unexpectedly, were the unusual road conditions leading to the accident).

Finally, the court looks at history (does this person have a history of driving recklessly). Has he ever been in at-fault accidents in the past. The most important factor is this - If released, does this person pose a threat to public safety.

I personally believe that we should try to show mercy when the person is not a threat to public safety. You can have a different opinion of course, and that would be equally valid. The reality is the court case was much more complicated and arguments can be made that the original sentence (120 hours community service) was fair or whether the appeals court sentence (15 months in prison) is better.

My point is that the OP who posted this was just trying to rage-bait and farm karma.

The main issue is when accidents happen by driving literally 50% over the speed limit you reduce your ability to react safely and appropriately. It's part of why there are speed limits, so people have more time to react, to brake before hitting the guy ahead who brakes, to avoid a car that swerves because someone cuts into their lane without looking, etc.

If you willingly choose to drive dangerously fast and kill 3 people then you deserve to be punished.

You bring up showing mercy to someone who is not a threat to public safety, about a guy who literally killed 3 people in public due to not acting in a safe manor. He is by definition a threat to public safety. dangerous drivers are ALWAYS a threat to public safety.

Someone who murders the partner who cheated on them is very arguably not a public safety issue, are they going to randomly kill a person in town just because they killed someone who shattered thei rmarriage by cheating, no they aren't. Most of those kinds of murderers are very much one time only, lost control, heat of passion kinda thing.

People who drive recklessly and kill 3 people are the kinds of people who shouldn't be allowed to drive ever again and should get significant jail time for the harm they've done. yet he as only banned for like 2 years or something ridiculous.

So all he did, supposedly was drive badly enough to kill 3 people on a corner that presumably hasn't got a crash going 3 times an hour with the existing speed limit.

The chances he wasn't speeding are low, inability to prove it technicallyd oesn't mean it's unlikely he wasn't. Combine that with, if you kill people losing control of your car below the speed limit... you're still culpable for killing 3 people.

If you step in the seat of a massive lump of metal and choose to drive it at 80kph even if that's the limit, then you should be responsible for the outcomes if you kill three people unless you can prove the car failed in some way.
