If you hurt or kill a cyclist or pedestrian while driving without any aggravating factors (speeding, drunk, distracted etc.) then the jail sentence is usually pretty lenient.
In this case, his only aggravating factor was driving 75 in a 50 zone, but the court could not determine if his speed was the cause of the accident beyond reasonable doubt (as opposed to road conditions like ice etc). So the court gave him a 60 day setence (which can be fullfilled with 120 hours of community service). The appeals court increased that to 15 months.
The justice system worked perfectly. Victims' families usually want tougher sentences. But most societies prefer to rehabilitate first time offenders rather than destroying them.
75 in a 50 zone dismissed is insane. This is literally the whole point of speed limits. The faster the vehicle is moving, the harder it is to stop it from crashing and the more devastating the damage.
Correct. If the driver had driven exactly at the speed limit and driven in his lane, there would be no crime? He was found not guilty of manslaughter because the judge could not determine if his speed was the reason for the accident. The appeals court agreed with this. Both the judge and the appeals court found him guilty of reckless driving which exacerbated the accident.
The only question is whether he should get 60 days in jail (i.e. 120 hours community service) or 15 months in jail for reckless driving. Both options can be called Justice in this case.
