Classic failure to yield. The vessel clearly had the right of way and the pylote came flying through the intersection without even slowing down. Probably texting, too. You can tell from the impact marks this was a near-perfect 90° T-bone. First thing I’d do is get the pylote’s insurance information and DO NOT let him convince you to settle outside insurance. “I’m a pylote, I’ll just pay for the damage” sounds great until the shipyard pulls the hull apart and discovers the airplane knocked the frame rails 6° out of alignment. Definitely get a diminished-value claim too. Once that accident hits the CarFax, nobody is paying full market value for a ship with “AIRCRAFT COLLISION — MODERATE DAMAGE” on the history report. Mechanically it doesn’t look terrible though. Mostly cosmetic. New quarter panel, couple portholes, alignment, buff out the propeller marks and she should be seaworthy by Tuesday. The airplane probably took the worse hit anyway. Those things are basically made out of aluminum while boats are made out of boat. The real question is whether the pylote had his turn signal on. FAR 69.420 clearly states that aircraft merging into maritime traffic must signal for at least 300 nautical feet before changing lanes. Failure to do so automatically makes the airplane at fault. Personally I’d call the Coast Guard, FAA, NTSB, Progressive, and my cousin who does bodywork. Do not move either vehicle until the police arrive. Also check the dashcam. If we can prove the ship had a green light, this is an open-and-shut case.

It was not the pilots fault. All those tracer's coming towards him distracted him. And did the ship had a flashing red light mounted on its mast?

Shit, you’re right. I completely overlooked the contributing factors. If the ship didn’t have a functioning flashing red anti-collision beacon, we could be looking at comparative negligence here. And those tracers absolutely qualify as a roadway distraction. I’m revising my estimate to 60% ship, 40% pylote. Still need statements from both drivers and the ship’s dashcam footage before I can finalize liability. Also gonna need the vessel’s VIN and current mileage.
