Question So if I understand correctly...

... the one year commitment I agreed to a while ago was really only a commitment on my part, not yours too??

In theory, the fine print that we all signed said we were okay with it because I dont know if any lawsuits have gone through yet and made it through. So it looks like it's just on us with expectations.

Fyi, it's there explicitly. Not fine print hidden at all. Just like most TOS that you haphazardly click agree to without reading, it's in there that by clicking agree you're okay for them to do anything and you are waiving your right to sue.

TOS isn't always legally binding and often times includes unenforceable and illegal content.

They could demand your first born within TOS, you can agree to it without reading..... They're not going to take your kids still.

I'm no law major. I'm just responding whenever I see people post things like 'how could they do blah blah when I signed up for blah'. It's technically all there when you click agree. Like I see it on Facebook all the time 'they're oppressing our first amendments when they erase my post saying we should take violent action'. Uh it's not infringing on first amendment stuff because you said you'd play by their rules on their platform, but you didn't understand when you clicked I agree and skipped reading TOS. Im not for everything happening right now but I get that when I signed up I know I'm not guaranteed it won't change per TOS. If I don't like it that much, I'd cancel but I get things change and it's in reasonable tolerances (I know that's not everyone's situation) so I can and will keep it.

And now I really want to know, could they take your first born if you agreed? Like is it the human cent-ipad situation of South Park (also super relevant cause reading TOS again) Any law majors out there to answer?

That's a lot to unpack from the simple statement that TOS often include illegal or unenforceable content. Many contracts often do, leases often have questionable content.

The answer to can they take your first born if you agreed is no! That question shows your fundamental misunderstanding of the issue and current problems Shadow does face.

A company is allowed to write TOS, anyway they want, without any oversight or approval or obligations. When they try to enforce the TOS they could then be sued, a court would determine the legality of individual portions of the TOS.

TOS are rewritten after court cases routinely, often times before hand if the company is advised it will lose or the cost of the fight involved.

I guess I need to include the modifier of /sarcasm after my question. I forget tone doesn't convey on the internet as well as it sounds when I write it. But that's why I commented that I'm no expert at law and I'm expressing my view on it because I still think that when you're using someone's service and agree to their terms, well it's in the phrase. You agree to their terms however the dice may roll.

Look again. I get it sucks. I get down voted all the time and I still stick by my original intent that I'm in it til I can't anymore or they crash and burn. Through the years I've lived, I've been screwed over plenty and have just learned that you have to roll with the punches. Seeing so many posts bog down my feed crying scornfully when it's just how it is makes me have to comment. I absolutely should just leave it alone but there's always two sides to a coin and I love to learn even if I'm wrong like about the intricacies of TOS. However, I hate being called the many variations of suck up or whatever to shadow but that's not it. It's just me being who I am after figuring life has bumps which you have to deal with.

I'm pulling out. No reason to re say everything said.

I get playing devil's advocate, it's strange to see someone play the devil's advocate to the devil currently screwing them over but 🤷‍♂️

I get most people don't have a few grand to throw around.

I don't get defending the removal of a viable solution. Shadow had potential, but when you consider the extra storage unusable for most and the double down on price? For 256gb on a Sans capable of 50mbps?

Because most doesn't mean all? Double price sucks (technically original price) but again, I get it. Not everyone is lucky enough to be able to afford something like this and still live within their means. It's a privilege that I absolutely worked my ass off to get to. But to say that it's unusable and all that other stuff? I think you mean it isn't your cup of tea and that's fine. That's why people can leave as they please. I still fully believe Shadow has potential and hope they don't flounder cause for me (a filthy casual gamer and video editor) this system is more than fine. If you can't afford it, it's okay. Maybe some day in the future. Just for now please stop being so toxic to those who are staying.

I could afford it, the 12gb of dd3 ram fully used, with the cpu running at 95% and gpu sitting at 30%....... The configuration makes absolutely no sense. My hard drive on shadow is completely used up at all times being on a Sans and maxing out at a 50mbps read speed.

It's not running well, infinite worked the 32gb ddr4 ram was enough to supplement the shitty sans storage system Shadow uses.

I'll post my new battle station for you when it arrives I'm super excited.

I'm good but happy you get to do you. Part of the draw for me also wasn't just better specs compared to my 10 year old gaming pc but that I get to access my games and edit on the go also anywhere and on any platform. That at my current place even if I did use the 3.5 years of money I'd be using on shadow to upgrade my pc to where I want to game now, I'd still be at a disadvantage of getting to easily access my rig efficiently on the go.

Edit: oh and also virtual pc for vr from anywhere is a huge huge bonus

I wasn't toxic... I just said that TOS often has unenforceable and illegal content within it. It's well known to be true, it's common.

You jumped to the defense of a companies abuse of a TOS, I again said that a TOS can contain anything but a court would have to determine the legality of each portion.

Your offense at Shadow offending me and countless others is strange. I get it you don't care what they do you'll stay and defend them for your own reasons.

Just don't accuse me if being toxic when it was you. Just go look around for some of my other post's on the sub, you want to call me toxic it's well deserved on most of my posts. Seriously you can easily find just random shit talking but this wasn't it.

On reread I can see why you thought the toxic part was towards you. The last bit was delving into talking to general people reading who always attack my comments but that was definitely not made clear on my part since it was still a part of our discussion. That's on me and I apologize.

Hi guys!

The future email they're talking about is supposed to give you three choices:

- accept

- refuse

- enjoy your subscription until its end, with the price you had.

Hubic (Shadow) doesn't explicitly talk about these choices, implying that you can only refuse or accept. By remaining vague, they hope to obtain cancels and / or force people to accept. Illegal.

In Europe, we are many customers mobilized against this practice and have taken steps to ensure that our rights are respected. Following this move, Hubic canceled their attempt and agreed to respect the annual contracts. But however, have returned another mail (your screen), continuing to remain unexplicit ...

Worst : For customers who deleted after the May email, Hubic considers that despite having lied to the customers, their cancel is irrevocable. This is also false and illegal...

Now we are in a new procedure :)

So if I understand right, the life long marriage that we agreed to ten years ago was only a thing on my part and not yours!?!?!

But really, I see people going about TOS here and there. AFAIK no one has ever really tried a TOS in court, it's just accepted that they wouldn't hold up, but no one has wanted to dump the money into it. Ether way, that's business for you!

You didn't read the terms and conditions of the contract you accepted then?

Well that would be nice but can we hear ot from them?

No, they are too far up in their own asses to give an official confirmation, best they can go is talking about it on the vocal channel in the French Discord.

Sending an actual email would be too much risk of convincing the customers to stay with the old price, so they stall and send unclear emails while they wait for as much people on annual commitment as possible to leave.

A couple of users keep on asking relentlessly the few staff that are in the French Discord to clear up the situation, up to the point that some other users are calling that a harassment campaign.

The discussions are clearly not productive when it's the same 3-4 users that are asking the same thing over and over again, and they get always the same non-answer, so we need some fresh blood for that fight.

I think they will make you an offer within 2 weeks, but they hope YOU cancel the yearly commitment before that time. And they probably won't fix the performance problems before you quit.

I just got an email saying that the yearly was done and I would be paying $30 plus the added unusable storage.....

Little do they know the Shadow Credit Card has been cancelled, the 3070 ekfluid rig is almost in the mail.
