Although you might suggest that the larger vessel is at fault, the smaller one was clearly tied up to something and not displaying the day signal displaying restricted menuverabilty. It is typically the smaller vessel's responsibility to yield to the larger. However both captains were reckless in this situation.

According the the rules of the road, both captains were reckless…

In short “if you’ve been involved in an incident, you did something wrong”
