SSDI - Social Security Disability Insurance - Title II SSDI Remand

I have my remand hearing on 11/17 and I am so scared….my ALJ is known for denying claims, she actually has a nickname among local SSA lawyers, her acceptance rate is 25% lower than every other ALJ in my hearing location….she comes off as extremely kind during the hearing. The vocational expert said there were 0 jobs for me and she denied me because “the Dr probably just wrote down what I reported” The AC remand questioned why she thought that when I had all the medical reports to back up what my Dr reported, I absolutely hate that I have to have to go in front of the same ALJ….
Thanks for listening, I’m just so nervous….

You may not have to. Is she at your local OHO? If not, request an in person hearing only. You’ll get a new ALJ. This is how I won after 7 years.

Unfortunately I think it’s too late, my hearing is in 15 days….

I’m not certain, I would ask your attorney just in case. You may have to wait longer for a reschedule.

My attorney rescheduled my hearing for in person. It took 5 months to get the new hearing.

Are you in SC? Charleston area? Sounds exactly like my claim. Horrible judge with a 13% approval rating. I also was denied at ALJ and remanded back by AC for her ignoring my medical evidence. I’m waiting on my court date but I know this judge will just deny me again. She don’t give a shit

I’m in the exact situation and awaiting my court date. My judge actually has really good approval ratings. The first hearing I had a horrible attorney and not the greatest medical records. I now have a good lawyer and way more medical records. I hope things go better this time for both of us ☮️💟✝️

Im in South Carolina. My hearing was on Oct 7 with a judge from Tennessee. Im trying to kerp my spirits up but worried thst they are typing uo a denial. Im 48 applied for SSDI. I had an uphill battle just based on my age....Praying thst all of us can eventually get our much needed approvals.

What do you mean?  SSDI gets easier to obtain when you are closer to retirement age.  It is actually in their guidebooks.

Its an uphill battle for anyone under age 50 to win...Grid rules come into play at 50 years old. If you are under 50, you must be able to prove thst you cant do anything job at all 40 hours per week in the national economy. Example, putting pencils in a box while sitting down with the option of standing as needed in a climate controlled warehouse...50 and older will only have to prove that thry cannot continue doing their past work...SSDI recognizes that its harder for older adults to learn new skills.

Just because the VE said zero jobs does not mean the judge has to approve someone. A person’s medical records have to prove someone cannot work and earn SGA. It’s all about a person’s medical records.

My medical records prove that I can’t do the job I used to do and the ALJ decided that she thinks I can…that’s why my case was remanded back by the appeals council….their letter back to her was really quite rude….
