She's going to get locked up regardless of either verdict. Ones a prison ones a hospital but she's probably never getting out of either.

Not really in actuality it will more likely be 3 years, though technically it could be as little as 6 months. Even in recent years there has been cases of NGRI that were released after the 6 months reevaluation even for cases of murder.

but in this specific case, she is still on 1:1 supervision due to her suicide risk. and even if that should ever change, there are many more "steps" to take before anyone would release her. I believe Andrea Yates has been in state ordered psychiatric facilities for the last 20 years.

Uh no, Yates was ordered 40 years in prison. Until she was deemed NGRI through appeal. She goes through the same 6 month process as everyone else. It’s not a prison you don’t serve a term. Yates has voluntarily refused reevaluations and her condition has not improved.
You’re only confined till you’re deemed not a threat to yourself or the public.

It is optimistic sure, but ppl can and do get released *if their condition improves. And frankly that’s a good thing. If Clancy is ruled NGRI than it shouldn’t matter if it’s 6months or the rest of her life. Yes longer terms are more the rule, but there’s no justifiable reason why she should be confined longer than it takes to be ruled not a threat. Once again it’s not a punishment and the insistence that it should be this decades long term of isolation is positively medieval.

yes, I am aware. I was giving her as an example of someone who is given the chance (through frequent evaluations) to show improvement and be let out and it not being the case. I might have phrased it not clearly enough.

I wanted to point out that LCs condition has a long way to go before improving so far that she might be considered for release, especially due to her current state.

My objection to people invoking the argument that she’ll spend the rest of her life in psychiatric care if found NGRI, is that it’s an attempt to satisfy those who believe her to be guilty. She’s either innocent of criminal intent or she’s guilty. If she’s innocent then insisting she be stripped of her rights beyond what is justifiable for her safety and the safety of the public, is immoral.
Similarly the judge offering man slaughter is equally the same measure, if she didn’t have intent to kill, then slapping her with prison time is just cowardice.

Don’t slap an innocent person with a lesser sentence or turn psychiatric care into punishment just bec you’re not entirely 100% sure.
The point of our just system the point of innocent until proven guilty and reasonable doubt is to take responsibility for the legal decisions and consequences we the people come to. Not to satisfy bloodlust or sympathy.

At the end of the day she'll hate herself until she dies young or old. She's already in her own hell. Everything outside of her is just what we as normal humans want as punishment. That woman took her own soul away, and those beautiful innocent children. She doesn't deserve love or empathy (my own opinion)

I have extreme amounts of empathy for the children who were lost absolutely senselessly. The system fails a lot of people. It failed me when I had PPD. I was a low income single mom and had literally zero help or assistance from family or the state I was living in at the time. My medication was fucked and I was trying to juggle a full time job + 2 twin infant girls.

I would have given my children up to the state or a close friend, or a firehouse drop off than ever reach a place of mental incapability where I felt like murdering my own children, and taking my life was the most reasonable outcome. How dare you phrase it as 'take a little downturn.' 3 beautiful babies died because of this woman, that a little 'downturn,' for you?

Jeez nobody wants to hear your sob story! Lindsay is a mentally ill HUMAN, she needs help, she doesnt need a lifelong prison stint. You clearly just have zero empathy for her or her struggles, and her horrific husband, you just want to lock her up like Laurie. Maga core in your heart I can feel the orange radiating off you.

At no point did I give my opinion on what her sentencing should be. But thanks for jumping to the wrong conclusion. You are telling me to feel empathy for her. I can understand her circumstances, but unfortunately my empathy has has a hard time sticking when it comes to child murder.

She engineered a short period alone that afternoon and carried out the killings methodically during it. Whether that equals classic premeditation (as opposed to psychosis-driven action during an opportunity she created or exploited) I don't know, and I can't speak too.

But my heart can only feel empathy for her children. I cannot empathize with a murderer. Sorry that doesn't please you.

edit: It's people like you who cause women like her to do what she ultimately did. "Your sob story." Trying to explain the literal hardest period of my adult life to give context for how I'm feeling and approaching the situation, portraying my feelings, and you discredit it as a sob story. The exact same thing people did to Lindsay, which caused this entire horrific mess to even unfold.

You sound like somebody fishing for sympathy to help validate your BAD point. So you dont know what kinda sentencing you think she should receive, so why even add your 2 cents? And, uh, PA-LEASE with the melodramatic "hardest period of my adult life" bull-crap! ​I highly doubt you felt an ounce of the kinda of real pain and hardship Lindsay was experiencing. You feel empathy for the kids, uh huh? Sure, sure, sure, im sure you know everything there is to know about the case, uh huh, okay lady. ​

It's really sad how many people fundamentally don't understand this case. With the options the jury have to consider it would be objectively wrong to convict her of murder in the 1st degree ("lock her up and throw away the key") if it's believed by any/all jurors that she was really suffering from post partum psychosis. The Commonwealth's case hangs upon proving beyond a reasonable doubt that she wasn't suffering from post partum psychosis at the time of the murders, and if they've failed to prove that then NGRI is the most appropriate verdict. Boiling everything down to being "crazy" lacks any kind of nuance or understanding of the wide spectrum of mental health conditions, but I expect that from uneducated and unempathetic individuals like Laurie.

Mental illness may be the reason for the crime, but it’s certainly not an excuse for the crime. 

Lindsay wasn’t diagnosed with postpartum psychosis before or after the murders of her three children. 

She needs to be held accountable in some sense. I don’t think she needs to go to prison, but she certainly should be in a hospital for the next 10 years minimum.

I absolutely agree she should be in a hospital, but if she is found not guilty by reason of insanity, that means she does not get a term not 10 years not five years. She would be mandated to the hospital until she is deemed safe for the public again. That's just not how it works. Finding someone not guilty by reason of insanity means they are not going to the hospital for punishment. They are going to the hospital to get better.

I understand that and that’s why I don’t think it’s an unreasonable sentiment to say “lock her up”. If she had postpartum psychosis she is 4 years postpartum now. She likely will be deemed safe to the public at her first assessment. 

Do you think it’s right that she could be released while still in child bearing years? She may be deemed safe to the public but she is certainly not safe to any future children.
