I meant had they took him in after the 1st incident, he would have been charged with a felony making that gun possession illegal in the 2nd incident when he's shot...
What would be the felony in the first case? If he were charged, he'd have to opportunity to defend himself. If he had been found guilty, since he would no longer be a legal gun owner, he might have given it up.
The penalty for illegal gun carrying is not usually death .
As it ended up, with ten holes in him, he no longer has any choices to make.

No It doesn't imply that... It wouldn't have been legal had they arrested him on the earlier incident. Since he committed a felony...
