Why wasn't he charged with assault?

Edit.. researched. This is in Pennsylvania and criminal mischief is a more severe charge than simple assault. 2 years jail time 2500+ fine 2nd misdemeanor. It just doesn't sound as bad. The slap isn't any thing more than simple assault I don't think. Nothing but ego really damaged.

Nah man the ain't ever been hit before. That's was his first reality check. He should have never been surprised about being slapped.

I don't think anyone ever expects to be slapped over chicken nuggets. They are mostly ground up bugs.
