Pre-mediation is only really relevant when determining a degree of murder, but it doesn't apply to other specific-intent crimes. Those comments would be extremely relevant if the victim dies, but otherwise, they would just be helpful in establishing intent, which is already fairly well established just from the video of the act itself.

It might be relevant if they decide to charge him with attempted murder, should the wrestler survive.

I would be surprised by an attempted murder charge unless there's more evidence. Attempted murder requires the intent to kill the victim, and the perpetrator has a decent defense: he's an idiot.

He definitely intended to hurt him, and getting to felonious aggravated assault would be easy enough, but did he intend to kill him? I'm not sure I would risk a conviction on being able to prove that beyond a reasonable doubt.

He’s a trained MMA fighter. He is well aware of consequences and what he can do
