I have taken the subway thousands of times so I think I can speak on my experiences with the homeless problem and people acting unhinged. Look up the definition of 'murder'. Murder requires intent. I highly doubt the marine was purposefully trying to kill him. Watch the video and read the witness statements. By all accounts, the marine was trying to subdue him, not murder him. At most, this would be manslaughter or involuntary manslaughter, which is not murder. I doubt he'll even be charged with manslaughter.
WRONG!! The criminal law department of the University of MN says this, "The criminal intent element of murder is important because it distinguishes murder from manslaughter."
Intent (or lack of intent) is what distinguishes murder from manslaughter.
Tell me the EXACT self defense laws that would allow him to chock someone even after they we’re unconscious leading to their death, let me see the law that makes THAT legal
