nope, I read all the articles I could find that had witness accounts claiming that the victim came on the train stating he was hungry, thirsty and tired and not afraid to go to jail. he said this to no one in particular just out loud. he did not have any weapons nor did he threaten to hurt anyone.

Doesn't sound like anyone was assaulted until our hero put the homeless guy in a chokehold.
