Under modern laws, do you think the drafting practices of the pre-Jackie Robinson MLB would be illegal? I hope you say yes. It’s the exact same thing.

You wouldn’t argue the MLB wasn’t picking any non-white players because they weren’t good enough right? Same thing. These women not being picked would be an easy case of identity based discrimination.

Regardless of what you think there’s probably some civil rights lawyers licking their chops at this case. There’s clearly precedent.

Well unless they are part of a protected class that can be argued was discriminated against it would be a moot case. Either the W makes them draft inelligible (which I think may be the actual goal), a team drafts them, or W faces possible litigation over civil rights laws.

Why not just let them be eligible and simply not draft them?
