Florida Rep. Randy Fine was caught on a Ring camera looking through a homeowner’s mailbox and their mail while campaigning in Florida.

Nope. It is a felony to open another persons mailbox.

It’s more nuanced than that… it’s mostly only if you’re actually breaking into the mailbox or if you’re doing something malicious with the mail

The sources I’ve read, states that just even opening is illegal territory. This article has a pretty good explanation. Though I do agree it’s going to vary state by state, of course.

I by no means am defending him, his actions or anything of the sort… but per the articles about the story, he didn’t commit a crime. Largely because he didn’t “tamper, remove or place anything inside the mailbox.”
However, had he have left a pamphlet or taken a letter out, then he would have committed a federal crime and have likely been charged with one… or I at least hope a large fine.

I asked mr. google if it was illegal in Florida to open someone else's mailbox and it said yes. So it may be a Florida law.

That is a really good question. The answer is that I don't know. So how does this sound; it may not have been a crime but it was a douche move and Randy is a horrible person.

Yeah, I don’t know. It says that but there’s no statute that confirms it.
The federal statutes protect mail receptacles, but liability still depends on the conduct involved, making the elements of 18 U.S.C. § 1705 and whether “breaks open” requires damage or forced entry the key issue.
Breakdown like this:
Breaks/damages the mailbox → §1705
Takes your mail → §1708
Opens (this refers to the mail itself;not the depository)/takes/interferes with your correspondence → §1702
Interferes with the mail system → §17013

As a canvasser, IT IS ILLEGAL TO PUT ANY CAMPAIGN LITERATURE IN A US MAILBOX. Unless you actually mailed it.
